Newell,P.E., Public Works Director <br /> SUBJECT: <br /> Ordinance Amending City Code, Chapter 38, Stormwater Ordinance <br /> SUMMARY RECOMMENDATION: <br /> Staff requests that Council pass the proposed ordinance amendments regarding City Code Chapter 38, Stormwater,which adds to <br /> the exemptions and credits for storm water service charges. <br /> BACKGROUND: <br /> Additional credits have been requested for inclusion in the City Code for Stormwater. The proposed changes to Article 38.27. <br /> (F).5 of the City Code are outlined as follows: <br /> f.Allowance for other governmental entities to provide educational programs in return for stormwater fee credit. <br /> g.Add a"Public Transportation Credit"for public transportation facilities that cannot detain stormwater on site as typically <br /> required by the City. <br /> PRIOR COUNCIL ACTION: <br /> February 2,2006—The Storm Water Ordinance was presented to the City's Planning Commission who gave the ordinance a <br /> favorable recommendation <br /> February 21, 2006-Council met in Study Session to discuss a Storm Water Ordinance,which would replace Chapter 38, <br /> Soil Erosion <br /> March 6,2006-Council approved Ordinance No. 2006-13,amending City Code Chapter 38, Storm Water Ordinance. <br /> November 3,2008-Council approved Resolution No. 2008-184 authorizing a memorandum of understanding between the <br /> MS4 group and Macon County Soil and Water Conservation District to assist the community to meet the requirements of the <br /> NPDES permits. <br /> January 18,2011—Council approved Ordinance No. 2011-04,amending City Code Chapter 38, Storm Water Ordinance to <br /> add land disturbance permits as required by the phase II requirements of the City's NPDES permit for a stormwater system <br /> April 22, 2014—Council approved Ordinance No. 2014-14,amending City Code Chapter 38, Storm Water Ordinance to add <br /> the stormwater utility. <br /> August 3,2020—Council approved Ordinance No. 2020-123,amending City Code Chapter 38, Storm Water Ordinance to <br /> add to the land disturbance permit fee requirements. <br />
