Legal Department
DATE: 5/9/2022
MEMO:
TO: Mayor Julie Moore Wolfe&Members of the Decatur City Council
FROM: Scot Wrighton,City Manager
Wendy Morthland,Corporation Counsel
SUBJECT: Ordinance Amending City Code,Chapter 41,Miscellaneous Street Regulations.
SUMMARY RECOMMENDATION: It is recommended that the proposed ordinance be approved.
BACKGROUND:
The proposed revisions to Chapter 41 remove what will become conflicting and antiquated code language that would otherwise
be in conflict with a new food truck ordinance.
The revisions to Chapter 41 also remove fees for certain commercial uses of city-owned sidewalks in the central business
district--while retaining the requirement that commercial uses must still get formal permission to use sidewalks from the city and
meet all other code requirements. The city continues to evaluate ways to stimulate new businesses downtown and assist those
already operating there. These ordinances advance this view.
The proposed ordinance also makes other minor formatting changes in the language of Chapter 41.
PRIOR COUNCIL ACTION: The City Council acted to temporarily remove sidewalk use fees during the pandemic. These
short-term revisions have now expired.
ATTACHMENTS:
Description Type
Ordinance Amending Chapter 41 Miscellaneous Street Ordinance
Regulations
