Legal Department
DATE:
MEMO:
TO: Mayor Julie Moore Wolfe&Members of the Decatur City Council
FROM: Scot Wrighton,City Manager
Wendy Morthland,Corporation Counsel
SUBJECT: Ordinance Adding City Code, Chapter 55.1 Mobile Food Units,Temporary Vendor Stands and Food and
Beverage Carts
SUMMARY RECOMMENDATION: It is recommended that the ordinance be adopted.
BACKGROUND: The proposed ordinance allows food trucks everywhere in the city if the zoning permits such a use. The
proposed ordinance allows for the issuance of 12-month permits, and requires that all food truck placements be off the city-
owned right of way and placed a minimum distance from any"bricks-and-mortar"restaurants. The proposed ordinance allows
food trucks to sell their products from 6:00 am to 12:00 midnight, but they have to provide a place for customers to use rest
rooms if they stay in one place for more than 3 hours. Food trucks that are in town for a special event or celebration that is less
than 4 days in length where an umbrella organization is responsible to the city(or other authorized group)for the management of
the special event, including placement of food trucks, then the food truck does not have to get permits(because these
requirements will be met by the event sponsor). All food trucks, however, regardless of the during of sales, must obtain food
handling permits from the county health department.
PRIOR COUNCIL ACTION: Simultaneous action to delete provisions of Chapter 41 and Chapter 67 of the City Code are
required to eliminate overlap or conflict with older(now antiquated)code sections.
POTENTIAL OBJECTIONS: Some downtown restaurants have opposed legislation allowing food truck in the central
business district, despite the limitations and restrictions placed on their operation by the proposed ordinance.
ATTACHMENTS:
Description Type
Ordinance Adding City Code Chapter 55.1 Mobile Food
Units,Temporary Vendor Stands and Food and Beverage Ordinance
Carts
