enforceable.In such case the Contract Documents shall be construed,to the fullest extent permitted by law,to give <br /> effect to the parties'intentions and purposes in executing the Contract. <br /> §7.9 Notice <br /> §7.9.1 Except as otherwise provided in Section 7.9.2,where the Contract Documents require one party to notify or <br /> give notice to the other party,such notice shall be provided in writing to the designated representative of the party to <br /> whom the notice is addressed and shall be deemed to have been duly served if delivered in person,by mail,by <br /> courier,or by electronic transmission in accordance with AIA Document E203TM-2013,Building Information <br /> Modeling and Digital Data Exhibit,if completed,or as otherwise set forth below: <br /> (If other than in accordance with AIA Document E203-2013, insert requirements for delivering Notice in electronic <br /> format such as name, title and email address of the recipient and whether and how the system will be required to <br /> generate a read receipt for the transmission) <br /> §7.9.2 Notice of Claims shall be provided in writing and shall be deemed to have been duly served only if delivered <br /> to the designated representative of the party to whom the notice is addressed by certified or registered mail,or by <br /> courier providing proof of delivery. <br /> §7.10 Relationship of the Parties <br /> Where the Contract is based on the Cost of the Work plus the Contractor's Fee,with or without a Guaranteed <br /> Maximum Price,the Contractor accepts the relationship of trust and confidence established by this Agreement and <br /> covenants with the Owner to cooperate with the Architect and exercise the Contractor's skill and judgment in <br /> furthering the interests of the Owner;to furnish efficient business administration and supervision;to furnish at all <br /> times an adequate supply of workers and materials;and to perform the Work in an expeditious and economical <br /> manner consistent with the Owner's interests.The Owner agrees to furnish and approve,in a timely manner, <br /> information required by the Contractor and to make payments to the Contractor in accordance with the requirements <br /> of the Contract Documents. <br /> ARTICLE 8 OWNER <br /> §8,1 Information and Services Required of the Owner <br /> §8.1.1 Prior to commencement of the Work,at the written request by the Contractor,the Owner shall furnish to the <br /> Contractor reasonable evidence that the Owner has made financial arrangements to fulfill the Owner's obligations <br /> under the Contract.The Contractor shall have no obligation to commence the Work until the Owner provides such <br /> evidence.If commencement of the Work is delayed under this Section 8.1.1,the Contract Time shall be extended <br /> appropriately. <br /> §8.1.2 The Owner shall furnish all necessary surveys and a legal description of the site. <br /> §8.1.3 The Contractor shall be entitled to rely on the accuracy of information furnished by the Owner but shall <br /> exercise proper precautions relating to the safe performance of the Work. <br /> §&IA Except for permits and fees that are the responsibility of the Contractor under the Contract Documents, <br /> including those required under Section 9.6.1,the Owner shall secure and pay for other necessary approvals, <br /> easements,assessments,and charges required for the construction,use,or occupancy of permanent structures or for <br /> permanent changes in existing facilities. <br /> §8.2 Owner's Right to Stop the Work <br /> If the Contractor fails to correct Work which is not in accordance with the requirements of the Contract Documents, <br /> or repeatedly fails to carry out the Work in accordance with the Contract Documents,the Owner may issue a written <br /> order to the Contractor to stop the Work,or any portion thereof,until the cause for such order is eliminated; <br /> however,the right of the Owner to stop the Work shall not give rise to a duty on the part of the Owner to exercise <br /> this right for the benefit of the Contractor or any other person or entity. <br /> §8.3 Owner's Right to Carry Out the Work <br /> If the Contractor defaults or neglects to carry out the Work in accordance with the Contract Documents,and fails <br /> within a ten-day period after receipt of notice from the Owner to commence and continue correction of such default <br /> Init.
