2. The additional fifty percent(50%)of the total eligible <br /> reimbursement after the issuance of the second Final Certificate of <br /> Occupancy by the City of Decatur's Building Inspections Division <br /> for the second of the Single-Family Homes as part of the Project. <br /> b) The City shall provide Brady engineered design drawings and secure all <br /> necessary permits from the Illinois Environmental Protection Agency for the <br /> Water Main extension attached hereto as Exhibit C. <br /> c) After annexation, extension of the water main to the Development <br /> Parcel and securing all necessary permits from the Illinois Environmental <br /> Protection Agency, Brady shall be permitted to connect to the City water mains <br /> as described by the City's Director of Public Works. <br /> d) Brady shall use and exercise all reasonable means and facilities to install water <br /> transmission lines (the Water Lines) within the Development Parcel sufficient <br /> to carry an adequate supply of water to service the Development Parcel. Said <br /> lines shall be constructed in accordance with City standards and all applicable <br /> City codes and ordinances. <br /> 7. SEWERS. DRAINAGE AND TREATMENT FACILITIES. <br /> a) Brady shall be responsible for securing all necessary permits from the Illinois <br /> Environmental Protection Agency and the Decatur Sanitary District to connect <br /> to the existing sanitary sewer owned by said District. <br /> b) Brady shall use and exercise all reasonable means and facilities to install <br /> sanitary sewer lines within the Development Parcel sufficient to serve the <br /> Development. Said lines shall be constructed according to plans approved by <br /> the City's Director of Public Works. <br /> c) Brady shall cause the entire Development Parcel to be annexed to the Decatur <br /> Sanitary District prior to making any sewer connections and shall pay any <br /> necessary annexation fees. <br /> 8. CONTRACTORS. Brady shall employ experienced contractors for construction of all <br /> subdivision improvements. <br /> 9. PREVAILING WAGES. In the construction of the Water Main extension within the <br /> Public Right of Way and/or Public Utility Easement, Brady shall pay prevailing wages as <br /> determined pursuant to the Prevailing Wage Act of the State of Illinois, 820 ILCS 130 et <br /> seq and the Prevailing Wage Ordinance of the City subject to the following: <br /> a) A listing of the current prevailing wage rates is available through the Illinois <br /> Department of Labor. <br /> b) Contractors must sign the City of Decatur Notice of Prevailing Wage Act form, <br /> and and other documents as requested to show compliance with this Act. <br /> 10. MISCELLANEOUS. <br /> a) Where this Agreement is silent, City ordinances shall apply and control. It is <br /> further understood and agreed by the parties that this Agreement shall be read <br /> in pari materia with the City's Subdivision Ordinance and Zoning Ordinance, <br /> 3of5 <br />
