Public Works <br /> DATE: 9/9/2022 <br /> MEMO: 2022-54 <br /> TO: Honorable Mayor Julie Moore Wolfe and City Council Members <br /> FROM: Scot Wrighton, City Manager <br /> Matt Newell, P.E., Public Works Director <br /> SUBJECT: <br /> Resolution Authorizing Amendment Number 3 to an Agreement with Clark Dietz Inc.to Provide Professional <br /> Engineering Services to the City of Decatur <br /> City Project 2020-13 <br /> SUMMARY RECOMMENDATION: <br /> It is recommended that the City Council approve the attached Resolution authorizing the Mayor to sign,and the City Clerk to <br /> attest,to Amendment Number 3 to a professional services agreement between the City of Decatur and Clark Dietz Inc. to <br /> provide professional engineering services to the City,for a fee not to exceed$249,950.35. <br /> BACKGROUND: <br /> The Engineering Division of the Public Works Department approved personnel roster that includes 4 engineers (City Engineer, <br /> Assistant City Engineer—Transportation,Assistant City Engineer—Water Utility,and Civil Engineer I)and 7 Engineering <br /> Technicians (2 Technician IIl,3 Technician II,and 2 Technician I). The Division currently has 2 unfilled Assistant City Engineer <br /> positions,which the City has been actively trying to fill since January 2022(Transportation Engineer has been vacant since May, <br /> Water Engineer was approved in the FY 2022 Budget). <br /> In 2022,the City filled all the open Engineering Technician positions and the Civil Engineer I position was filled in June but has <br /> not received any qualified applicants for the Assistant City Engineering positions. <br /> Many communities and busineses are struggling to fill vacant civil engineer positions. Given these difficulties, it is preferable to <br /> continue to contract out a portion of the services needed by the Engineering Division,to keep storm,sewer,transportation,and <br /> water infrastructure projects,internal operations,and other services,required by the Public Works Department, on track. <br /> Professional Services Agreement Amendment Number 3 <br /> Over the past year,Clark Dietz Inc. (CDI)has provided the additional staff needed to assist the Public Works Engineering <br /> Division fulfill its obligations to the City. They have provided an employee that typically spends three days a week at the City <br /> offices with additional tasks distributed to other CDI staff as needed. Amendment Number 3 will provide additional hours for <br /> various sewer,storm,transportation,and water engineering services. The amendment cost of$249,950.35 is estimated to last <br /> through FY 2023 but could change depending on the need and use. The contract is billed by the actual hours worked for the City <br /> and can be reduced or ended if positions are filled and the services are no longer needed. <br /> PRIOR COUNCIL ACTION: <br /> September 8, 2020-City Council authorized the original agreement with Clark Dietz Inc. for professional services for a not to <br /> exceed fee of$187,670. <br /> May 3,2021 -City Council authorized the Amendment No. 1 to the agreement with Clark Dietz Inc. for professional services <br /> for a not to exceed fee of$84,752.40. <br /> December 20,2021 -City Council authorized the Amendment No. 2 to the agreement with Clark Dietz Inc. for professional <br /> services for a not to exceed fee of$124,971.80. <br /> POTENTIAL OBJECTIONS: None. <br /> INPUT FROM OTHER SOURCES: Clark Dietz Inc. <br /> STAFF REFERENCE: Matt Newell,Public Works Director and Paul Caswell,City Engineer.
