Public Works DATE: 9/9/2022 MEMO: 2022-54 TO: Honorable Mayor Julie Moore Wolfe and City Council Members FROM: Scot Wrighton, City Manager Matt Newell, P.E., Public Works Director SUBJECT: Resolution Authorizing Amendment Number 3 to an Agreement with Clark Dietz Inc.to Provide Professional Engineering Services to the City of Decatur City Project 2020-13 SUMMARY RECOMMENDATION: It is recommended that the City Council approve the attached Resolution authorizing the Mayor to sign,and the City Clerk to attest,to Amendment Number 3 to a professional services agreement between the City of Decatur and Clark Dietz Inc. to provide professional engineering services to the City,for a fee not to exceed$249,950.35. BACKGROUND: The Engineering Division of the Public Works Department approved personnel roster that includes 4 engineers (City Engineer, Assistant City Engineer—Transportation,Assistant City Engineer—Water Utility,and Civil Engineer I)and 7 Engineering Technicians (2 Technician IIl,3 Technician II,and 2 Technician I). The Division currently has 2 unfilled Assistant City Engineer positions,which the City has been actively trying to fill since January 2022(Transportation Engineer has been vacant since May, Water Engineer was approved in the FY 2022 Budget). In 2022,the City filled all the open Engineering Technician positions and the Civil Engineer I position was filled in June but has not received any qualified applicants for the Assistant City Engineering positions. Many communities and busineses are struggling to fill vacant civil engineer positions. Given these difficulties, it is preferable to continue to contract out a portion of the services needed by the Engineering Division,to keep storm,sewer,transportation,and water infrastructure projects,internal operations,and other services,required by the Public Works Department, on track. Professional Services Agreement Amendment Number 3 Over the past year,Clark Dietz Inc. (CDI)has provided the additional staff needed to assist the Public Works Engineering Division fulfill its obligations to the City. They have provided an employee that typically spends three days a week at the City offices with additional tasks distributed to other CDI staff as needed. Amendment Number 3 will provide additional hours for various sewer,storm,transportation,and water engineering services. The amendment cost of$249,950.35 is estimated to last through FY 2023 but could change depending on the need and use. The contract is billed by the actual hours worked for the City and can be reduced or ended if positions are filled and the services are no longer needed. PRIOR COUNCIL ACTION: September 8, 2020-City Council authorized the original agreement with Clark Dietz Inc. for professional services for a not to exceed fee of$187,670. May 3,2021 -City Council authorized the Amendment No. 1 to the agreement with Clark Dietz Inc. for professional services for a not to exceed fee of$84,752.40. December 20,2021 -City Council authorized the Amendment No. 2 to the agreement with Clark Dietz Inc. for professional services for a not to exceed fee of$124,971.80. POTENTIAL OBJECTIONS: None.
