AGREEMENT BETWEEN THE CITY OF DECATUR AND DECATUR AREA HABITAT FOR HUMANITY REGARDING RESIDENTIAL REHABS UTILIZING AMERICAN RESCUE PLAN FUNDS This Agreement ("Agreement") is made and entered into between the City of Decatur, Illinois, an Illinois municipal corporation ("City") and the Decatur Area Habitat for Humanity ("DAH4H"),for and in consideration of the mutual covenants and promises and good and valuable consideration contained herein. WHEREAS, the City has received funds from the American Rescue Plan funds ("ARP"); and, WHEREAS,the ARP funds received by the City may be used for specific eligible activities including increasing the supply of affordable and high-quality housing in our urban core; and, WHEREAS, DAH4H is a not-for-profit organization formed in 1987 with its principal office located in Decatur, Illinois to assist families in the Decatur and Macon County through the construction of and rehabilitation of good affordable houses; and, WHEREAS,the City would benefit from DAH414 rehabilitating and managing residential rehabs in Decatur. NOW, THEREFORE, in consideration of the mutual promises and covenants, it is agreed between the parties hereto the following: Section 1. The City agrees to provide to DAH4H a maximum of Two Hundred Fifty Thousand Dollars ($250,000.00) to be dispersed in two equal installments of One hundred and twenty-five thousand dollars ($125,000) from its portion of the ARP funds pursuant to and under the terms of this Agreement. Section 2. The City and DAH4H agree to cooperatively work on select residential rehab of homes whereby these ARP funds will pay for materials and expenses for these projects and DAH4H partners with area high schools to utilize these homes for construction training within a general framework as approved by the Executive Director of DAH4H and the City of Decatur City Manager or his designee. Section 3. DAH4H will be responsible for reviewing and determining all applicable federal, state and local laws, statutes and other regulations relating to the use of ARP funds provided under this Agreement. Section 4. The ARP funds provided by the City shall be used by DAH4H on homes provided by or approved the City of Decatur. Additionally, these funds must be used in a manner consistent with and in compliance with the use of the ARP funds as set forth in all applicable federal, state and local laws, statutes, and other regulations to be paid out on a per project basis.
