ORDINANCE NO. 2022-� <br /> ORDINANCE AUTHORIZING CONSUMPTION OF ALCOHOLIC LIQUOR <br /> ON PUBLIC RIGHTS-OF-WAY 100 BLOCK OF MERCHANT <br /> STREET & 100 BLOCK OF EAST PRAIRIE STREET <br /> DOWNTOWN DECATUR CHRISTMAS WALK <br /> WHEREAS, Decatur Area Arts Council has requested the closure of the 100 Block of <br /> Merchant Street and the 100 Block of East Prairie Street for the Downtown Decatur Christmas <br /> Walk; and, <br /> WHEREAS, it is the intention of downtown participating merchants to offer alcoholic <br /> beverages for sale to patrons for consumption only within the street closure area; and, <br /> WHEREAS, such consumption of alcoholic liquor at the Downtown Decatur Christmas <br /> Walk requires the express approval of the City Council. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That on the day listed herein, and only on such day, between the hours listed <br /> opposite said day, alcoholic beverages may be consumed at the Downtown Decatur Christmas <br /> Walk, said day and hours being particularly described as follows: <br /> Wednesday, December 7, 2022 5:00 p.m.—8:00 p.m. <br /> Section 2. That no alcoholic beverage may be consumed as provided herein unless such <br /> alcoholic beverage is in a non-breakable container. <br /> Section 3. That establishments licensed for the sale of alcoholic liquor within the street <br /> closure area may allow patrons to remove purchased alcoholic liquor from those establishments if in <br /> non-breakable containers. <br /> Section 4. That this ordinance is expressly conditioned and approved upon the Decatur Area <br /> Arts Council providing to the City of Decatur an agreement which will hold the City of Decatur <br /> harmless for any and all damages incurred by persons attending this event and indemnifying the <br /> City for any and all damages and lawsuits. <br /> Section 5. That all debris shall be removed by Decatur Area Arts Council. prior to reopening <br /> public rights-of-way. <br /> Section 6. That except as otherwise provided herein, the provisions of Section 34(a) of <br /> Chapter 52 of the City Code remain in full force and effect. <br />
