ORDINANCE NO. -q9 <br /> AN ORDINANCE AMENDING CITY CODE <br /> OF THE CITY OF DECATUR,ILLINOIS <br /> BY THE ADDITION OF CHAPTER 41.3 <br /> -DOWNTOWN PARKS- <br /> WHEREAS,the City of Decatur, Illinois, an Illinois municipal corporation,has the <br /> authority to adopt ordinances and to promulgate rules and regulations that pertain to its <br /> government and affairs and that protect the public health, safety and welfare of its citizens; and, <br /> WHEREAS, Central Park, Preston Jackson Park, Memorial Band Shell and the Transfer <br /> House are owned and operated by the City of Decatur; and, <br /> WHEREAS,these properties are utilized by the City of Decatur for various City <br /> organized and/or sponsored events; and, <br /> WHEREAS, the above properties are available for use by the public for certain events <br /> under agreements with the City of Decatur; and, <br /> WHEREAS,the maintenance and preservation of these properties is a considerable <br /> expense for the City to maintain in an acceptable condition for their use and enjoyment; and, <br /> WHEREAS, safety of persons using the properties is a significant and legitimate interest <br /> of the City; and, <br /> WHEREAS, damage, destruction and vandalism is occurring at the properties with <br /> greater frequency resulting in additional resources being needed for the maintenance and <br /> preservation of the properties; and, <br /> WHEREAS, the damage, destruction, vandalism and threat to public safety most often <br /> occurs during the late evening and early morning hours; and, <br /> WHEREAS, the City Council believes that the damage, destruction, vandalism and threat <br /> to public safety would be reduced by the closure of the properties during certain time period; <br /> and, <br /> NOW, THEREFORE BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS AS FOLLOWS: <br /> Section 1. The facts and statements contained in the preamble to this Ordinance are found <br /> to be true and correct and are hereby adopted as part of this Ordinance. <br /> Section 2. That the City Code of the City of Decatur be, and the same is hereby modified <br /> and amended by adding a new Chapter 41.3 titled "Downtown Parks" thereto. Said new Chapter <br /> 41.3 shall provide as set forth in Exhibit A attached hereto and made part hereof. <br />
