January 12, 2023 <br /> TO: Mayor Julie Moore Wolfe& Decatur City Council Members <br /> FROM: Scot Wrighton,City Manager <br /> RE: Amendments to the Alcoholic Beverage Code <br /> It is recommended that the City Council adopt the proposed ordinance amending the Alcoholic <br /> Beverage Code.The proposed ordinance makes 3 substantive revisions: <br /> 1. Amends the description of a Class"L" licensee to increase the square footage limitation, <br /> reduce the number of allowed Class "L" licenses, and removes the 60%sale threshold. <br /> Class "L" language still has restricted hours, prohibits video gaming and imposes other <br /> limitations.This revision is recommended to facilitate the development and opening of <br /> a new business in the former Talbots store on the street level of the Hickory Point Bank <br /> Building downtown.The new business will offer a unique approach to on-premises retail <br /> wine tasting, and the subsequent package sales of wine and other alcoholic beverages. <br /> 2. Amends the Alcoholic Beverage Code by adding language regulating BYOB arrangements <br /> at businesses that do not possess an on-site "pour' liquor license. <br /> 3. Amends the Alcoholic Beverage Code by increasing the Class"A" license cap by one (1). <br /> This revision is required to comply with the contract and settlement arrangement <br /> reached between the city and MWAA/Tammy Hiser for the acquisition of land and <br /> buildings needed for the Brush College project—a site known as the "New Back Door." <br /> Under the terms of this contract,the city is required to grant a Class"A" liquor license to <br /> Niemann Foods, increase the maximum allowable Class"A"licenses, if necessary,to <br /> grant a new Class "A" license, and to subsequently allow video gaming wherever <br /> Niemann Foods locates the Class "A" license. <br /> Niemann Foods plans to use the license at their West Grand retail strip.They already know they <br /> will not receive any tax increment financing proceeds for this development,since the existing <br /> TIF redevelopment plan does not allow funding for a Class"A" liquor establishment,or for a <br /> Laundromat. <br />
