ORDINANCE NO. Wl3^OL ORDINANCE AMENDING CITY CODE -CHAPTER 54.1 - -VIDEO GAMING LICENSE— BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: WHEREAS,the City of Decatur is a home rule unit of local government pursuant to Article VII, Section 6 of the Constitution of the State of Illinois of 1970; and, WHEREAS, the City of Decatur has the authority to adopt ordinances and promulgate rules and regulations that pertain to its government and affairs, and to review, interpret and amend its ordinances,rules and regulations; and, WHEREAS,the City of Decatur has the authority to regulate certain businesses including video gaming under its police power; and, WHEREAS, the Council of the City of Decatur has expressed concern regarding the proliferation of video gaming terminals throughout the City and its effects on its citizens; and, WHEREAS, certain businesses are applying for liquor licenses solely to obtain the eligibility for video gaming terminals even though there is a limitation on the number of video gaming parlors; and, WHEREAS,to deter certain classes of liquor licenses from being abused for the sole intention of operating a video gaming establishment, amendments to liquor license classifications will be required; and, WHEREAS, staff is presently preparing amendments to present to Council to accomplish this goal; and, WHEREAS, until those amendments are presented to Council and adopted, staff recommends a temporary six(6)month moratorium on the issuance of video gaming licenses for new applicants not received at the City as of January 1, 2023 for the location requested. NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS, as follows: SECTION 1. That the above recitals are hereby declared to be true and correct findings of the City Council of the City of Decatur and are incorporated herein. SECTION 2. That a moratorium on the issuance of new video gaming licenses under Chapter 54.1 of the City Code is hereby placed on new applicants not received at the City as of January 1, 2023 for the location requested.
