1/10/23,2:42 PM Item Coversheet <br /> '® <br /> Public Works <br /> DATE: 1/9/2023 <br /> MEMO: 2023-08 <br /> TO: Honorable Mayor Julie Moore Wolfe and City Council Members <br /> FROM: Scot Wrighton,City Manager <br /> Mattew Newell,P.E.,Public Works Director <br /> SUBJECT: Resolution Authorizing a Stipulated Agreement Concerning Safety Improvements at the At-Grade Crossing with <br /> Illinois Central Railroad Company at Clinton Street <br /> SUMMARY RECOMMENDATION: <br /> It is recommended that the City Council approve the following Resolution authorizing Stipulated Agreement 2243 between the <br /> Illinois Commerce Commission(ICC),Illinois Central Railroad Company(IC),the City of Decatur,and the Illinois Department of <br /> Transportation(IDOT)to complete safety improvements at the Clinton Street highway-rail grade crossing with the IC railroad <br /> tracks. <br /> BACKGROUND: <br /> The Illinois Commerce Commission has evaluated the at-grade crossing with the IC railroad at Clinton Street(see attached <br /> location map)and has recommended safety improvements to include the installation of warning lights and gates at the railroad's <br /> intersection with Clinton St and Division St. The crossing is currently controlled with yield signs.The railroad improvements of <br /> the three warning lights and gates installation does not require any participation from the City and will be owned and maintained <br /> by the railroad. <br /> LEGAL REVIEW: Legal reviewed and approved the agreement on January 9,2023. <br /> PRIOR COUNCIL ACTION: <br /> There have been no prior Council actions on this Stipulated Agreement. <br /> POTENTIAL OBJECTIONS: There are no known objections to the Stipulated Agreements. <br /> INPUT FROM OTHER SOURCES: <br /> Illinois Commerce Commission,Illinois Central railway Company and the Illinois Department of Transportation. <br /> STAFF REFERENCE: Matthew Newell,Public Works Director,and Paul Caswell,City Engineer.Matthew Newell will be in <br /> attendance at the City Council meeting to answer any questions of the Council on this item. <br /> BUDGET/TIME IMPLICATIONS: <br /> Budget Impact: No budget impacts. <br /> Staffing Impact: Staff time has been allocated for this work. <br /> ATTACHMENTS: <br /> Description Type <br /> Resolution Authorizing a Stipulated Agreement <br /> Concerning Safety Improvements at the At-Grade Resolution Letter <br /> Crossing with Illinois Central Railroad Comply-t. <br /> lin n Street <br /> https://decatur.novusagenda.com/agendaweb/CoverSheet.aspx?ltemlD=4190 1/2 <br />
