cancellation or amendment of its policy. <br /> 2.14 Lien Waivers. <br /> All contracts for construction of the water line extension project shall provide that all <br /> contractors and subcontractors shall furnish contractor's affidavits in the form provided by <br /> state statute and that waiver of liens be required for all payments made. <br /> 2.15 Rights of Inspection. <br /> During construction of the Project,the City or its designee shall have the right at any time <br /> and from time to time to enter upon the Project for the purposes of inspection with fourteen <br /> (14) day written notice or as mutually agreed to by the Parties. Inspection by the City of <br /> the Project shall not be construed as a representation by the City that there has been <br /> compliance with the Construction Plans or any building or life safety codes adopted by the <br /> City; or that the Project will be or is free of faulty materials or workmanship, or a waiver <br /> of any right the City or any other party may have against the Developer or any other party <br /> for noncompliance with the Construction Plans, Preliminary Plans, building or life safety <br /> codes or any other ordinances of the City or the terms of this Agreement. <br /> 2.16 Highway Access. <br /> All arrangements for curb cuts and street access on highways, streets and roadways must <br /> be made by the Developer with the applicable jurisdiction. The City makes no <br /> representations whatsoever with respect to the allowance, approval or permits of curb cuts <br /> and street access with respect to the Project or Project Site; however, the City agreed to <br /> provide a vacant lot(2634 N Morgan St.) to potentially serve as another access option to <br /> Morgan St. <br /> 2.17 Enterprise Zone. <br /> Developer may apply for Enterprise Zone benefits through the Economic Development <br /> Corporation of Decatur and Macon County seeking a waiver of State and local sales taxes <br /> on the purchase of those eligible materials used in the Project, which have a building <br /> permit. The City shall make reasonable efforts to assist Developer in obtaining the above <br /> listed benefits from the Economic Development Corporation of Decatur and Macon <br /> County. <br /> 2.18 Water Line Construction. <br /> The City agrees to reimburse the Developer for the reasonable cost of constructing a new <br /> four-inch (4) water line as specifically set forth in Exhibit 2. Design, permit fees and <br /> obtaining of any necessary IEPA permits for the construction of this water line shall be the <br /> responsibility of the City. The Developer shall be responsible for perpetual maintenance <br /> of said water line after it leaves the Morgan St. public right of way. <br /> ARTICLE III: CITY OBLIGATIONS <br /> 3.1 Public Investment. <br /> The City shall provide the public incentives pursuant to Article IV below. <br /> 3.2 Zoning. <br /> The property is already zoned M-1 and M-2 zoning and allows for the proposed use. <br />
