Section 2. The City agrees to provide One Hundred Fifty Thousand Dollars ($150,000) <br /> in calendar year 2023 and One Hundred Fifty Thousand Dollars ($150,000) in calendar year <br /> 2024 from its portion of the ARPA funds to CILBA for administering and implementing housing <br /> assistance programs. <br /> Section 3. The City will be responsible for determining any additional criteria and <br /> eligibility for housing assistance programs that may not be included in the IHDA or ARPA <br /> funding agreement and notify CILBA in writing. <br /> Section 4. CILBA shall be responsible for the administration and implementation of all <br /> housing assistance programs, including the use of funds pursuant to the provisions of this <br /> Agreement between parties. <br /> Section 5. CILBA will be responsible for reviewing, following and determining all <br /> applicable federal, State and local laws, statutes and other regulations relating to the use of <br /> ARPA funds and IHDA's Home Repair and Accessibility Program funds provided under this <br /> Agreement. <br /> Section 6. The ARPA Funds provided by the City shall only be used by CILBA for the <br /> purposes of and pursuant to and under the terms of this Agreement. <br /> Section 7. CILBA hereby acknowledges and agrees that if it fails to comply with any of <br /> the provisions of this Agreement or if the Housing Assistance Programs funds are used for or in <br /> any manner contrary to those uses set forth in this Agreement, City may, in its sole discretion, <br /> terminate this Agreement and, upon written demand by the City, CILBA will repay to the City <br /> the funds used contrary to the terms set forth herein. <br /> Section 8. Upon request, CILBA agrees to provide to the City or its duly authorized <br /> representatives, access to any books, documents,papers and records of CILBA which pertain to <br /> the Housing Assistance Programs and/or the funds provided to CILBA for the purpose of <br /> monitoring, making audits, examinations, and photocopying. <br /> Section 9. CILBA shall be required to maintain all records for the period designated by <br /> the City as required by the terms of ARPA, IHDA and any other laws, statutes and other related <br /> regulations including,but not limited to, financial records setting forth all disbursements under <br /> this Agreement. <br /> Section 10. CILBA agrees to provide any and all reports which may be required by the <br /> City for compliance with ARPA, IHDA, Freedom of Information Act and any other federal or <br /> state law, statute or other regulation. <br /> Section 11. CILBA agrees to comply with Title VI of the Civil Rights Act of 1964; Title <br /> VII of the Civil Rights Act of 1968; Section 104(b)and Section 109 of the Housing and <br /> Community Development Act of 1974, as amended; Section 504 of the Rehabilitation Act of <br /> 1973; the American with Disabilities Act of 1990 as amended, and the Age Discrimination Act <br /> of 1975 as amended. <br />
