R2023-18 Resolution Authorizing Agreement between City of Decatur, Illinois and Central Illinois Land Bank Authority Regarding Housing Assistance Programs

Section 2. The City agrees to provide One Hundred Fifty Thousand Dollars ($150,000) in calendar year 2023 and One Hundred Fifty Thousand Dollars ($150,000) in calendar year 2024 from its portion of the ARPA funds to CILBA for administering and implementing housing assistance programs. Section 3. The City will be responsible for determining any additional criteria and eligibility for housing assistance programs that may not be included in the IHDA or ARPA funding agreement and notify CILBA in writing. Section 4. CILBA shall be responsible for the administration and implementation of all housing assistance programs, including the use of funds pursuant to the provisions of this Agreement between parties. Section 5. CILBA will be responsible for reviewing, following and determining all applicable federal, State and local laws, statutes and other regulations relating to the use of ARPA funds and IHDA's Home Repair and Accessibility Program funds provided under this Agreement. Section 6. The ARPA Funds provided by the City shall only be used by CILBA for the purposes of and pursuant to and under the terms of this Agreement. Section 7. CILBA hereby acknowledges and agrees that if it fails to comply with any of the provisions of this Agreement or if the Housing Assistance Programs funds are used for or in any manner contrary to those uses set forth in this Agreement, City may, in its sole discretion, terminate this Agreement and, upon written demand by the City, CILBA will repay to the City the funds used contrary to the terms set forth herein. Section 8. Upon request, CILBA agrees to provide to the City or its duly authorized representatives, access to any books, documents,papers and records of CILBA which pertain to the Housing Assistance Programs and/or the funds provided to CILBA for the purpose of monitoring, making audits, examinations, and photocopying. Section 9. CILBA shall be required to maintain all records for the period designated by the City as required by the terms of ARPA, IHDA and any other laws, statutes and other related regulations including,but not limited to, financial records setting forth all disbursements under this Agreement. Section 10. CILBA agrees to provide any and all reports which may be required by the City for compliance with ARPA, IHDA, Freedom of Information Act and any other federal or state law, statute or other regulation. Section 11. CILBA agrees to comply with Title VI of the Civil Rights Act of 1964; Title VII of the Civil Rights Act of 1968; Section 104(b)and Section 109 of the Housing and Community Development Act of 1974, as amended; Section 504 of the Rehabilitation Act of 1973; the American with Disabilities Act of 1990 as amended, and the Age Discrimination Act of 1975 as amended.
