(3) The fact that any person charged with violating this Section is or has been <br /> legally entitled to use alcohol or drugs or any combination of them, shall not constitute a defense <br /> against any charge of violating this Section. <br /> S. All boats shall be subject to a no wake speed limit during the time period of 1 hour after <br /> sunset to sunrise, provided that this section shall not apply to patrol, law enforcement and <br /> emergency response boats. <br /> T. No motorboat shall be equipped with any motor or other propulsion machinery beyond <br /> its safe power capacity and safe carrying capacity, taking into consideration the type and <br /> construction of such motorboat and other existing operating conditions. <br /> U. It is unlawful to operate a motorboat without a mouth,hand or power operated whistle, <br /> horn or other device, capable of producing a blast of two seconds or more in duration and audible <br /> for at least one-half mile. <br /> V. All motorboats fueled with gasoline, other than those propelled by a detachable <br /> outboard motor, must have a U.S. Coast Guard approved backfire flame arrestor on each <br /> carburetor. <br /> W. Except for open boats,all motorboats which use fuel having a flashpoint of 110 degrees <br /> Fahrenheit or less shall have at least two ventilator ducts, fitted with cowls or their equivalent, for <br /> the efficient removal of fumes from the bilges of every engine and fuel tank compartment. There <br /> shall be at least one exhaust duct installed so as to extend from the open atmosphere to the lower <br /> portion of the bilge and at least midway to the bilge or at least below the level of the carburetor air <br /> intake. The cowls shall be located in such a manner to prevent displaced fumes from being <br /> recirculated. <br />
