R2023-40 Resolution Authorizing an Agreement between the Staley Family Foundation and the City of Decatur

AGREEMENT This Agreement is entered into between the City of Decatur, an Illinois home rule municipal corporation ("City"), and the Henry M. Staley Declaration of Charitable Trust, an Illinois Charitable Trust more commonly known as the Staley Family Foundation("Foundation") for contributions made to advance and promote the memory and community contributions of A. E. Staley, on the occasion of the centennial of Lake Decatur in 2023. WHEREAS, A.E. Staley was a visionary industrialist who financed numerous community projects in Decatur during his lifetime; and, WHEREAS, Lake Decatur would likely not exist today were it not for the foresight and strategic thinking of A. E. Staley; and, WHEREAS, the Staley Family Foundation is keen to take steps ensuring that current and future generations of Decatur residents have an opportunity to learn about the significant and lasting contributions A. E. Staley made to the development and growth of Decatur, and in particular, the creation of Lake Decatur; and, WHEREAS, the Staley Family Foundation shares the city's interest in taking steps to ensure that the reservoir A. E. Staley created remains clear, clean and not burdened by erosion and poor watershed management so that it remains a high quality source of drinking water, industrial process water, and local recreation for many generations to come; NOW THEREFORE, the parties to this Agreement make the following covenants and pledges: SECTION ONE: The City will host and manage a centennial "Decatur Lake Fest" on the 100th anniversary of the dedication of Lake Decatur in July 2023, located on the shores of the lake, that both commemorates the work of A. E. Staley, and re-introduces Lake Decatur to the citizens of Decatur in a festive and accessible manner. SECTION TWO: The City will formally name Basin #3 of Lake Decatur as the "Staley Basin,"and develop a suitable plan for marking, signage and public designation of Basin#3 as the "Staley Basin"readily visible to all persons entering the "Staley Basin" area by car,boat, on-foot and other non-motorized methods. The new basin designation will be registered with Google and other cartographic sources used in the production, manufacture, distribution (both printed and electronic) of maps that include Lake Decatur. The Foundation and the City will jointly approve the plan for marking and designating the "Staley Basin." SECTION THREE: The City will take all necessary and legal steps to ensure that the formal designation of the "Staley Basin" is retained, maintained and continuously marked in accordance with the terms of Sections Two and Four of this Agreement for a period of ninety-nine (99) years. SECTION FOUR: The City will, in close coordination with the staff of the Staley Museum, develop and construct appropriate historical markers to be installed on public property adjacent to Lake Decatur in both Basin#2 and the new"Staley Basin"to provide historical context and narrative about the history of Lake Decatur and the role played by A.
