CONTRACT A-pr��- THIS CONTRACT,made and entered into this _ay af`Mtriaeh,2023,by and between the City of Decatur,Illinois,an Illinois municipal corporation,hereinafter called"Owner",and E.L.Pruitt Co.,hereinafter called the"Contractor". WITNESSETH: That for and in consideration of the payments,covenants,and agreements stated herein, the Contractor and Owner agree as follows: 1. The Contractor shall perform and complete in a good and workmanlike manner all work required in connection with all documents, terms and conditions set forth in the bid documents entitled "Transit HVAC Replacement IFB# Transit 2022- 06", as well as the base bid and Alternate#4 submitted by Contractor(hereinafter referred to as"Contract Documents") including any and all Addenda prepared by the Engineer,with specifications and drawings set forth in the Contract Documents made a specific part of this Contract; and in strict compliance with the Contract Documents; and the Contractor shall do everything required by this Contract According to the contractor's price schedule, base bid price is $174,495.00 and Alternate #4 price is $53,455.00. Therefore, the contract shall not exceed $227,950.00. Any additional work will not be paid without a prior written price approval and approved work change order. 2. Payments are to be made to the Contractor by the Owner in accordance with and subject to the provisions embodied in the documents made a part of this Contract, or as prescribed by law. 3. Work under this Contract shall commence on the date specified in the written Notice to Proceed from the Owner to the Contractor. Upon receipt of said Notice, the Contractor shall diligently and continuously prosecute and substantially complete all Work under this Contract. 4. A Completion Date for this project is May 1,2023.A change order will need to be executed should the project exceed completion date. 5.
