ORDINANCE NO. 2023 —1-7 ORDINANCE AUTHORIZING NEGOTIATION AND EXECUTION OF NEGOTIATED EASEMENT WITH ARCHER-DANIELS-MIDLAND COMPANY FOR THE UNDERGROUND INJECTION AND SEQUESTRATION OF CO2 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the grant of an Easement to Archer-Daniels-Midland Company ("ADM") for UNDERGROUND INJECTION AND SEQUESTRATION OF CO2, for various properties owned by the City of Decatur may be granted upon mutual agreement by the City and ADM subject to the conditions contained herein. Section 2. That the grant of any Easement is expressly conditioned upon ADM receiving all necessary and required permits for the underground injection and sequestration of CO2 from the Illinois Environmental Protection Agency and or the United States Environmental Protection Agency prior to any injection of CO2. Section 3. That the grant of any Easement is expressly conditioned upon ADM's agreement to pay to the City the sum of$450 per acre under which ADM injects and/or stores CO2. Section 4. That the City Manager or his designee is authorized to negotiate with ADM to determine the properties to be included in the Easement and the terms and conditions for such Easement. Section 5. That the Mayor and City Clerk be, and they are hereby, authorized and directed to execute said easement for the sequestration of CO2 upon agreement by the parties.
