Wacker Drive, Suite 4600, <br /> Chicago, Illinois 60601 (the"Grantee"), its successors and assigns,the exclusive, and, <br /> irrevocable easement(except as noted below) and right-of-way to use the subsurface of the <br /> Grantor's land described on Exhibit A attached hereto and made a part hereof("Grantor's <br /> Land"), limited to all the area beneath 4,500 feet below ground surface of the Grantor's Land <br /> (including, without limitation, all pore space therein,the"Storage Complex") for the purposes <br /> set forth herein. <br /> The easement granted by the Grantor to the Grantee pursuant to this instrument is an <br /> exclusive and irrevocable easement(except as noted below)and right-of-way to use the Storage <br /> Complex for the sequestration of carbon dioxide("CO2"), including, without limitation,to inject <br /> or otherwise introduce CO2 streams in the Storage Complex; to store and sequester CO2 streams <br /> in the Storage Complex; to retain the possession and ownership of CO2 and CO2 streams so <br /> stored and sequestered as personal property; to remove CO2 and CO2 streams from the Storage <br /> Complex; to plug, monitor, and maintain the injection or monitoring wells; to conduct such other <br /> activities and operations in the Storage Complex as are necessary or advisable in connection <br /> 1 <br /> Classification:Confidential <br />
