ORDINANCE NO. ORDINANCE AMENDING CITY CODE CHAPTER 74 -SANITARY SEWER SYSTEM- BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That Chapter 74 of the City Code of Decatur, Illinois, be, and the same is hereby modified and amended by adding and deleting language to Sections 10 and 18. Said Sections 10 and 18 as so modified, amended and added, shall provide as follows: 10. RATE. (B) Effective May 1, 2022, and continuing annually on May I thereafter, Sewer User Charge Rates contained in this Chapter will increase by 2.5 percent or by the annual percentage change of the U.S. Department of Labor Midwest Urban Consumer Price Index for each corresponding January 1 to December 31 of the preceding year, whichever is greater, except for the year 2023 for which the increase will be 5.0 percent. The City Council must authorize any annual increase that is 5.0 percent or higher. (Amended, Ordinance No. 2022-13, April 4, 2022) (G) The owner of any structure within an area determined to be subject to high storm water induced inflow and infiltration who refuses to participate in City required building sewer or a drainage system repairs or improvements, will be charged a monthly fee of$50. The monthly charge will be assessed until building sewer or drainage system improvements are made by the owner and approved by the Public Works Director or the necessary easement and release document for said improvement is signed by the owner and approved by the Public Works Director.
