or other City approved connection to the public sewer. The property owner is responsible for the <br /> maintenance and repair of the building sewer. All costs and expenses incident to the installation, <br /> connection,repair and maintenance of the building sewer shall be the responsibility of the property <br /> owner. <br /> The owner of any structure wherein the building sewer or a drainage system is <br /> damaged, decayed or in a state of disrepair to such an extent as to create a threat to the <br /> health, safety and welfare of the public may be ordered to repair the sewer or drain, as the <br /> case may be,within a reasonable time frame determined by the Public Works Director after <br /> due notice is served upon the owner or occupant of the premises, in person or by certified <br /> mail, return receipt requested. If the threat persists and the owner has not-repaired the <br /> defect at the expiration of time frame set by the Public Works Director, the Public Works <br /> Director is hereby authorized to repair the sewer or drain, as the case may be, forthwith, at <br /> the expense of the City and recoverable against the owner, his successors and assigns. <br /> Repairs made pursuant to this section, upon filing a notice of lien with the recorder <br /> of the deeds of the county, shall constitute a lien in favor of the City against the premises <br /> on which the repairs were made. <br /> Any such installation, maintenance and repair performed on the service connection in the <br /> public right-of-way shall be in conformance with provisions of City Chapter 37, <br /> Construction and Excavation in Streets.
