Exhibit 1 <br /> FAP 320 (IL 121) <br /> Section: 135RS-4 <br /> CITY Section: 23-00306-00-TL <br /> Macon County <br /> Job No.: C-97-119-10 <br /> Agreement No.: JN 723 011 <br /> Contract No.: 74477 <br /> AGREEMENT <br /> This agreement entered into this VBImday of t,Nhz1 , A.D., 2023, by and between <br /> the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION <br /> hereinafter called the STATE, and the CITY OF DECATUR, in the State of Illinois, hereinafter <br /> called the CITY. <br /> WITNESSETH: <br /> WHEREAS, the STATE, in order to facilitate the free flow of traffic and ensure safety to <br /> the motoring public, is desirous of improving approximately 14,343 feet (2.7 miles) of FAP 320 <br /> IL 121), State Section 135RS-4, CITY Section 23-00306-00-TL from 0.6 miles northwest of <br /> Interstate 72 southeast to its intersection with University Avenue in Decatur, by milling and <br /> resurfacing, patching, constructing Americans with Disabilities Act (ADA) compliant curb ramps, <br /> modernizing existing traffic signal systems and by performing all other work necessary to <br /> complete the section in accordance with the approved plans and specifications; and <br /> WHEREAS, the improvements to FAP 320 (IL 121) shall consist of: <br /> 1. 3,000 FEET NORTHWEST OF INTERSTATE 72 TO 750 FEET NORTHWEST OF <br /> INTERSTATE 72: This portion of the project is not within the CITY limits of Decatur and are <br /> not discussed in this agreement. <br /> 2. 750 FEET NORTHWEST OF INTERSTATE 72 TO EAST OF UNIVERSITY AVENUE: Patch <br /> and construct hot-mix asphalt overlay on the existing variable pavement width, providing for <br /> four 12-foot wide through traffic lanes, two in each direction, as well as 12-foot wide and <br /> variable left and right turn lanes and 3-foot wide asphalt shoulders (where adjacent curb and <br /> gutter is present; 10-foot wide asphalt shoulders where no adjacent curb and gutter is <br /> present); remove and replace the existing 22-foot and variable non-mountable curbed <br />
