May 11, 2023
TO: Mayor Julie Moore Wolfe &Decatur City Council Members
FROM: Scot Wrighton, City Manager
RE: Resolution Authorizing Additional Fund Distribution to Crossing Healthcare and
Heritage Behavioral Health Center for Use of Opioid Settlement Funds
On February 6, 2023, the City Council adopted a resolution equally distributing up to $50,000 in
opioid settlement funds between Crossing Healthcare and Heritage Behavioral Health Center for
certain types of expenditures delineated in a joint proposal submitted by both providers. This
amount reflected settlement distribution amounts actually received or anticipated by the city of
Decatur at that time.
Since this council action, additional settlement proceeds have been received, and/or more are
anticipated. It is requested that the council's previous action be amended to allow equal
distribution up to an aggregate of$200,000 ($100,000 each),based on revised estimates from the
attorneys managing the settlement distributions, with all of it used for the same purposes as
described in the original proposal submitted by both providers (and previously approved by the
city). We now anticipate receiving a total settlement of approximately $174,000. The proposed
resolution provides that if the amount actually received by December 31,2023 exceeds $200,000,
then the city will request a full reporting of how the funds were used by Crossing Healthcare and
Heritage Behavioral Health Center. With this information, and new requests from each agency,
the City Council can make a new decision at that time regarding the best use of new opioid
settlement funds.
Settlement monies must be used for opioid addiction treatment, recovery, intervention and related
expenditures. A copy of the initial agreement and joint expenditure plan is attached.
