ORDINANCE NO.JL09-4- <br /> ORDINANCE AMENDING CITY CODE <br /> -CHAPTER 54.1 - <br /> -VIDEO GAMING LICENSE— <br /> BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> WHEREAS, the City of Decatur is a home rule unit of local government pursuant to <br /> Article VII, Section 6 of the Constitution of the State of Illinois of 1970; and, <br /> WHEREAS, the City of Decatur has the authority to adopt ordinances and promulgate <br /> rules and regulations that pertain to its government and affairs, and to review, interpret and <br /> amend its ordinances, rules and regulations; and, <br /> WHEREAS, the City of Decatur has the authority to regulate certain businesses including <br /> video gaming under its police power; and, <br /> WHEREAS, the Council of the City of Decatur has expressed concern regarding the <br /> proliferation of video gaming terminals throughout the City and its effects on its citizens; and, <br /> WHEREAS, certain businesses are applying for liquor licenses solely to obtain the <br /> eligibility for video gaming terminals even though there is a limitation on the number of video <br /> gaming parlors; and, <br /> WHEREAS,to deter certain classes of liquor licenses from being abused for the sole <br /> intention of operating a video gaming establishment, amendments to liquor license classifications <br /> will be required; and, <br /> WHEREAS, staff is presently preparing amendments to present to Council to accomplish <br /> this goal; and, <br /> WHEREAS, on January 17,2023, Council adopted a six (6)month moratorium on the <br /> issuance of video gaming licenses for new applicants not received at the City as of January 1, <br /> 2023 for the location requested which expires on July 17, 2023; and, <br /> WHEREAS,until those amendments are presented to Council and adopted, staff <br /> recommends an additional temporary moratorium on the issuance of video gaming licenses for <br /> new applicants not received at the City as of January 1, 2023 for the location requested. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS, as follows: <br /> SECTION 1. That the above recitals are hereby declared to be true and correct findings of <br /> the City Council of the City of Decatur and are incorporated herein. <br />
