ranks inferior to that rank, provided that the position or positions continue to be funded <br /> and authorized by the City Manager. If vacated position is not filled due to a lack of funding <br /> or authorization and is subsequently reinstated, the final promotion list shall be continued <br /> in effect until all positions vacated have been filled or for a period up to five (5) years <br /> beginning from the date on which the position was vacated. In such event, the candidate <br /> or candidates who would have otherwise been promoted when the vacancy originally <br /> occurred shall be promoted. <br /> A) If a vacancy occurs in the rank of Captain or Lieutenant and a promotional <br /> list exists at the time the vacancy occurs then all those entitled to be promoted shall have <br /> their time in grade seniority and pay scale retroactive back to the date of the vacancy. <br /> Promotional pay shall be effective from the date the promotion actually occurs. All <br /> vacancies shall be filled within 10 business days. <br /> B) If a Captain's promotional list does not exist but a Lieutenant's list exists, <br /> and a vacancy occurs in the Captain's rank, the promotions from Firefighter to Lieutenant <br /> will occur once a new Captain's register is completed. Once the Captain's promotional <br /> register is established, following the Fire Department Promotional Act, the Captain and <br /> Lieutenant vacancies shall be filled within 10 business days. The Captain's promotion in <br /> this case shall be dated on the date in which the promotional registry was certified by the <br /> Civil Service Commission. All time in grade seniority and pay scale shall be retroactive <br /> back to the date of the certification. Promotional pay shall be effective from the date the <br /> promotion actually occurs. The Lieutenant promotion in this case shall be dated from the <br /> date of the vacancy. All time in grade seniority and pay scale shall be retroactive back to <br /> the date of the vacancy. Promotional pay shall be effective from the date the promotion <br /> actually occurs. <br /> C) If a Lieutenant's promotional list does not exist and a vacancy occurs in the <br /> Lieutenant's rank, the promotions from Firefighter to Lieutenant will occur once a new <br /> Lieutenant's promotional register is established. Once the Lieutenant's promotional <br /> register is established, following the Fire Department Promotional Act, the Lieutenant <br /> vacancy shall be filled within 10 business days.
