Section 5. LLCU will provide the Program funds to those determined to be eligible at an interest rate not to exceed 3.25percent,payable over a maximum of one-hundred twenty(120) days. Section 6. LLCU will assess a one(1)percent administrative fee for each loan made and provided under the Program with the administrative fee to be remitted to the City of Decatur. Section 7. LLCU will be responsible for reviewing and determining all applicable federal, state and local laws, statutes and other regulations relating to the use of ARP funds provided under this Agreement. Section 8. The ARP funds provided by the City shall only be used by LLCU to provide financial assistance to those with approval from the City for the purposes of and pursuant to and under the terms of the Program. Section 9. LLCU hereby acknowledges and agrees that if it fails to comply with any of the provisions of this Agreement or if the Program funds are used for or in any manner contrary to those uses set forth in this Agreement, City may, in its sole discretion, terminate this Agreement and, upon written demand by the City, LLCU will repay to the City the funds used contrary to the terms set forth herein. Section 10. Repayment of the one(1)percent administrative fee by LLCU to the City shall be due and owing no later than thirty(30) days following demand of such repayment by the City. Section 11. Upon written request, LLCU agrees to provide to the City or its duly authorized representatives, access to any books, documents,papers and records of LLCU which pertain to the Program and/or the funds provided to LLCU for the purpose of monitoring, making audits, examinations, and photocopying. Section 12. LLCU shall be required to maintain all records for the period of time designated by the City as required by the terms of ARP and any other laws, statutes and other related regulations including,but not limited to, financial records setting forth all disbursements under this Agreement. Section 13. LLCU agrees to provide any and all reports which may be required by the City for compliance with ARP and any other federal or state law, statute or other regulation. Section 14. LLCU agrees to comply with Title VI of the Civil Rights Act of 1964; Title VII of the Civil Rights Act of 1968; Section 104(b) and Section 109 of the Housing and Community Development Act of 1974, as amended; Section 504 of the Rehabilitation Act of 1973; the American with Disabilities Act of 1990 as amended, and the Age Discrimination Act of 1975 as amended. Section 15. LLCU hereby assumes liability for and agrees to protect,hold harmless, and indemnify the City, its assigns, officers, employees, directors, agents and servants from and
