Exhibit A <br /> Jimmie Soules Bird Repelent Company <br /> 53 Benton Drive, Decatur, Illinois 62526 <br /> Phone 217-454-8437 <br /> AGREEMENT <br /> AGREEMENT made by and between the City of Decatur, Illinois, a municipal <br /> corporation ("City)and Jimmie Soules Bird Repelent Company("Soules). <br /> For and in consideration of the premises set out herein,the City and Soules agree as <br /> Follows: <br /> 1.Soules shall provide bird repellent services to all properties owned by the City located <br /> within the boundaries set out in paragraph 2 hereof. Said services shall be those determined to be <br /> necessary in the sole discretion of Soules to eliminate the noisome and unsanitary <br /> accumulation of birds on City property; provided that such services are in strict compliance <br /> with applicable Federal, State, and City statutes, ordinances, rules,and regulations, including <br /> but not limited to environmental and conservations laws, and further provide that such services <br /> do not constitute a nuisance to abutting property owners or the public. <br /> 2. The area within which Soules shall provide bird repellent services, as discussed above, <br /> is the area bounded by Cerro Gordo Street on the north, Martin Luther King on the east,Wood <br /> Street on the south, and Church Street on the west. <br /> 3. The bird repellent services to be provided by Soules, as required hereby, shall begin <br /> no later than October 1, 2023 and shall continue through September 30,2026. <br /> 4.The City shall pay Soules for the services described herein at the following rates,and <br /> according to the following schedule, except as provided in Paragraph 5 hereof: <br />
