MP-),-7 0 <br /> ORDINANCE AMENDING ZONING ORDINANCE <br /> -SECTION XXX ZONING BOARD OF APPEALS- <br /> WHEREAS, on the 5th day of October 2023 upon due notice, the Decatur City <br /> Plan Commission held a public hearing on the petition of Cordaryl Patrick, Director of <br /> Economic & Community Development,to modify and amend the Zoning Ordinance of the <br /> City of Decatur,the same being Ordinance No. 3512, as amended, to Section XXX Zoning <br /> Board of Appeals to reduce the quorum for the ZBA meetings from 5 members to 4 <br /> members and allow for a Hearing Officer to perform the power and duties of the Zoning <br /> Board of Appeals, if needed, so that said Zoning Ordinance as modified and amended shall <br /> provide as set forth herein. <br /> SECTION XXX. ZONING BOARD OF APPEALS <br /> A. ORGANIZATION <br /> 1. Composition of Zoning Board of Appeals <br /> A Zoning Board of Appeals is hereby established. Said Board shall consist of <br /> seven (7) members appointed by the Mayor with the approval of the Council. <br /> The term of office of each member shall be three (3)years. Vacancies shall be <br /> filled for the unexpired term of the member whose place has become vacant. <br /> The Mayor shall have the power to remove any member of the Board for cause, <br /> after notice and hearing. One of the members of the Board shall elected as Chair <br /> of the Board by the other members annually in October or at the retirement of <br /> the Chair. No member shall serve more than two (2)terms as Chair. <br /> 2. Conduct of meetings. <br /> Meetings of the Board shall be held at the call of the Chair and at such other <br /> times as the Board may determine. The Chair, or in his/her absence the acting <br /> chair, may administer oaths and compel the attendance of witnesses. All <br /> meetings of the Board shall be open to the public. The Board shall keep minutes <br /> of its proceedings, showing the vote of each member upon each question or, if <br /> absent or failing to vote, indicating such fact, and shall keep records of its <br /> examinations and other official actions, all of which shall be immediately filed <br /> in the office of the Board. <br />
