MP-),-7 0 ORDINANCE AMENDING ZONING ORDINANCE -SECTION XXX ZONING BOARD OF APPEALS- WHEREAS, on the 5th day of October 2023 upon due notice, the Decatur City Plan Commission held a public hearing on the petition of Cordaryl Patrick, Director of Economic & Community Development,to modify and amend the Zoning Ordinance of the City of Decatur,the same being Ordinance No. 3512, as amended, to Section XXX Zoning Board of Appeals to reduce the quorum for the ZBA meetings from 5 members to 4 members and allow for a Hearing Officer to perform the power and duties of the Zoning Board of Appeals, if needed, so that said Zoning Ordinance as modified and amended shall provide as set forth herein. SECTION XXX. ZONING BOARD OF APPEALS A. ORGANIZATION 1. Composition of Zoning Board of Appeals A Zoning Board of Appeals is hereby established. Said Board shall consist of seven (7) members appointed by the Mayor with the approval of the Council. The term of office of each member shall be three (3)years. Vacancies shall be filled for the unexpired term of the member whose place has become vacant. The Mayor shall have the power to remove any member of the Board for cause, after notice and hearing. One of the members of the Board shall elected as Chair of the Board by the other members annually in October or at the retirement of the Chair. No member shall serve more than two (2)terms as Chair. 2. Conduct of meetings. Meetings of the Board shall be held at the call of the Chair and at such other times as the Board may determine. The Chair, or in his/her absence the acting chair, may administer oaths and compel the attendance of witnesses. All meetings of the Board shall be open to the public. The Board shall keep minutes of its proceedings, showing the vote of each member upon each question or, if absent or failing to vote, indicating such fact, and shall keep records of its examinations and other official actions, all of which shall be immediately filed in the office of the Board.
