ADDITIONS AND DELETIONS <br /> - ZONING ORDINANCE — <br /> SECTION XXX. ZONING BOARD OF APPEALS <br /> A. ORGANIZATION <br /> 1. Composition of Zoning Board of Appeals <br /> A Zoning Board of Appeals is hereby established. Said Board shall consist of seven (7) <br /> members appointed by the Mayor with the approval of the Council. The term of office of <br /> each member shall be three (3) years. Vacancies shall be filled for the unexpired term of <br /> the member whose place has become vacant. The Mayor shall have the power to remove <br /> any member of the Board for cause, after notice and hearing. One of the members of the <br /> Board shall elected as Chair of the Board by the other members annually in October or at <br /> the retirement of the Chair. No member shall serve more than two (2)terms as Chair. <br /> 2. Conduct of meetings. <br /> Meetings of the Board shall be held at the call of the Chair and at such other times as the <br /> Board may determine. The Chair, or in his/her absence the acting chair, may administer <br /> oaths and compel the attendance of witnesses. All meetings of the Board shall be open to <br /> the public. The Board shall keep minutes of its proceedings, showing the vote of each <br /> member upon each question or, if absent or failing to vote, indicating such fact, and shall <br /> keep records of its examinations and other official actions,all of which shall be immediately <br /> filed in the office of the Board. <br /> 3. Hearing Officer <br /> The position of Hearing Officer is hereby established and given the authority to conduct <br /> public hearings and provide determinations in matters otherwise required to be heard by the <br /> Zoning Board of Appeals listed in Paragraph B. Power and Duties of this Section When a <br /> hearing officer is designated to conduct a public hearing or provide determination in matters <br /> otherwise required to be heard by the Board: <br /> a. Notice of hearing shall be given in the same time and manner as is provided bX <br /> this Ordinance for the giving of notice of hearing when any such matter is to be <br /> heard by the Board; <br /> b. The Hearing Officer in passing upon and determining any matter otherwise <br /> within the jurisdiction of the Board shall be governed by all of the standards <br /> rules and conditions imposed by this Ordinance to govern the Board when it <br /> passes upon and determines any such matter; and <br /> c. The Hearing Officer shall exercise and perform all the powers and duties of the <br /> Board in the same manner and to the same effect as provided in this Ordinance <br /> with respect to the Board. <br />
