OFFICE OF CITY MANAGER, TRANSIT DIVISION
January 19, 2021
TO: Honorable Mayor Julie Moore Wolfe and City Council Members
FROM: Scot Wrighton, City Manager
Jon Kindseth, Deputy City Manager
John Williams, Mass Transit Administrator
SUBJECT: Resolution Repealing R2020-183 and Authorizing Execution of an
Agreement for Management and Operation of City of Decatur Public Transit Services
with MV Transportation
RECOMMENDATION: Staff recommends that this item be approved as presented.
BACKGROUND: This item was discussed and ultimately the City Council approved
entering into an agreement with MV for a turn-key solution on December 21, 2020. The
City issued a notice to proceed to MV,while the final executable agreement was pulled
together for signatures. The agreement the City Council authorized was never executed
by MV. Due to a recent labor issue, between local ATU and MV, they are requesting a
modification to the force majeure section of the agreement. Our legal staff has reviewed
and modified their initial proposed language, and finds this modification acceptable for
the City. This agreement will be retroactive to 1/1/2021,as MV as continued to provide
service without interruption.
POTENTIAL OBJECTIONS: Staff is not aware of objections, though there are more
than 70 current DPTS employees impacted by this recommendation.
STAFF REFERENCE: Should the City Council have any questions, they may contact
Jon Kindseth at 450-2323 or ikind seth(d,decaturi1. ov;John Williams at 424-3552 or
iwiliiams@decaturil.gov
BUDGET/TIME IMPLICATIONS: The minor language modifications do not likely
have any direct financial impact on the City budget, versus previously authorized transit
agreement.
Attachments: Proposed Agreement(minor edits from approved agreement highlighted)
