The Developer shall Substantially Complete construction of the Project <br /> Phase I within seven(7)years from the date of this signed agreement or <br /> within two (2)years from commencement of construction or other <br /> mutually agreeable date. <br /> 2.18 Sewer Construction <br /> If needed and requested by Developer and upon Developer completing on- <br /> site pre-treatment, City agrees to construct a gravity sewer that shall <br /> connect Developer's manufacturing plant to the City's wastewater <br /> collection system at an estimated cost of$1.25 million dollars. If the <br /> Developer confirms the need to construct the gravity sewer, the City <br /> commits to construct, and the Developer agrees to contribute to City the <br /> sum of Two Hundred Thousand Dollars (US $200,000) for this sewer <br /> construction which shall be paid to the City upon completion and <br /> certification of the sewer. The sewer shall be of sufficient size and <br /> capacity to receive the expected and reported sanitary and process waste <br /> flows of the Project. Design, construction and obtaining of all necessary <br /> IEPA permits for the construction of this sewer shall be the responsibility <br /> of the City. City shall own and be responsible for perpetual maintenance <br /> of said sewer. <br /> 3. 3.A portion of ARTICLE III is hereby amended to provide, <br /> 3.4 Water. <br /> City can provide water for Project in an amount sufficient to meet <br /> Developer's reasonable demand requirement to a maximum of 750,000 <br /> gallons per day. Potable water connection shall be made at the Project <br /> property line in accordance with City Code and requirements and pay for <br /> said water in accordance with and consistent with City Code. Nothing in <br /> this Agreement shall obligate the Developer in purchasing and utilizing <br /> non-potable water from the City for use in its manufacturing process. <br /> 4.
