COMMUNITY DEVELOPMENT BLOCK GRANT CORONAVIRUS(CDBG-CV) <br /> AGREEMENT BETWEEN <br /> CITY OF DECATUR AND THE DECATUR PARK DISTRICT <br /> THIS AGREEMENT was made and entered into by and between the City of Decatur,an <br /> Illinois municipal corporation("City"),and the Decatur Park District,an Illinois unit of local <br /> government("District"),on the �day offt6tjW 2024. The parties mutually desire to <br /> enter into this Agreement and further stipulate and-a—grJ6 as follows: <br /> WHEREAS the 1970 Illinois Constitution,Art.VII,Section 10 and 5 ILCS 22013 provide <br /> authority for intergovernmental co-operation;and, <br /> WHEREAS City and the District are both public agencies as defined under the <br /> Intergovernmental Cooperation Act(5 ILCS 220/1 et.seq.),and are therefore authorized and <br /> empowered to enter into intergovernmental agreements whereby they may exercise,combine, <br /> transfer,and enjoy jointly any powers,privileges,functions,or authority;and, <br /> WHEREAS the District wishes to assist the City's neighborhood rehabilitation, <br /> renovation, and revitalization goals in the near west side of the City;and, <br /> WHEREAS the District is willing to alter the boundaries,configuration,and equipment <br /> in Garfield Park in a manner that advances a larger neighborhood catalyst project hereto and <br /> incorporated by reference as Exhibit A(hereinafter referred to as"Project");and, <br /> WHEREAS the Project will address two of the three national objectives for CDBG: <br /> benefiting low-moderate-income persons and preventing or eliminating slum and blight;and, <br /> WHEREAS the CARES Act"(CDBG-CV)"was created to prevent,prepare, and respond <br /> to the coronavirus;and, <br /> WHEREAS the District will reconfigure the park with equipment,play areas,and nature <br /> scape,to provide suitable outdoor fitness and social space where insufficient facilities are <br /> available to support social distancing guidance;and, <br /> WHEREAS residents are presumed to be Low-Moderate Income because of the nature <br /> and location of the Project which will benefit primarily LMI households;and, <br /> WHEREAS the defined service area is primarily residential in nature with at least 51%of <br /> the residents being low moderate income. <br /> NOW,THEREFORE,in consideration of the mutual covenants and promises contained <br /> herein,the adequacy and sufficiency of which are hereby acknowledged, the parties mutually <br /> agree as follows: <br /> 1 <br />
