Section 5. Any new appropriations shall occur only upon approval of the Decatur City <br /> Council. <br /> Section 6. NCF understands that the awarding of the grant under this Agreement in no <br /> way implies the continued financial support of the program or services by the City beyond the <br /> specified funded amount of this Agreement. <br /> Section 7. NCF shall be responsible for the administration, implementation, and <br /> reporting of the ARP funds provided in the Program made under the provisions of the <br /> Agreements between the parties. <br /> Section 8.NCF will provide the Program funds to those determined to be eligible <br /> contractors for the small home improvement program. <br /> Section 9.NCF will be responsible for reviewing and determining all applicable federal, <br /> state and local laws, statutes and other regulations relating to the use of ARP funds provided <br /> under this Agreement. The City will provide NCF will all rules and regulations governing the <br /> ARP funds. A [point person] from the City will be provided to NCF for guidance and direction <br /> on the ARP protocols and procedures to ensure NCF's ongoing compliance with ARP funding. <br /> Section 10. The ARP funds provided by the City shall only be used by NCF to provide <br /> financial grant assistance to eligible homeowners for the purposes of and pursuant to and under <br /> the terms of the Program. <br /> Section 11. NCF hereby acknowledges and agrees that if it fails to comply with any of <br /> the provisions of this Agreement, if the Program funds are used for or in any manner contrary to <br /> those uses set forth in this Agreement, or for the City's convenience, City may, in its sole <br /> discretion,terminate this Agreement and,upon written demand by the City,NCF will repay to <br /> the City the funds used contrary to the terms set forth herein no later than thirty(30) days <br /> following demand of such repayment by the City. <br /> Section 12. Upon written request,NCF agrees to provide to the City or its duly <br /> authorized representatives, access to any books, documents,papers and records of NCF which <br /> pertain to the Program and/or the funds provided to NCF for the purpose of monitoring, making <br /> audits, examinations, and photocopying. <br /> Section 13.NCF shall be required to maintain all records for the period designated by the <br /> City as required by the terms of ARP and any other laws, statutes and other related regulations <br /> including, but not limited to, financial records setting forth all disbursements under this <br /> Agreement. <br /> Section 14.NCF agrees to provide any and all reports which may be required by the City <br /> for compliance with ARP and any other federal or state law, statute or other regulation. <br /> Exhibit A <br />
