i <br /> INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF DECATUR, <br /> ILLINOIS AND DECATUR PUBLIC SCHOOLS DISTRICT 61 <br /> THIS INTERGOVERNMENTAL AGREEMENT is entered into between the Board of <br /> Education of Decatur Public School District No. 61 (hereinafter"District"or"School District"), <br /> and the City of Decatur, Illinois, an Illinois municipal corporation (hereinafter"City"). <br /> WHEREAS, the District is the owner of tracts of real estate, generally described as 1077 <br /> W. Grand Street, Decatur, Illinois as shown on the map attached hereto as Exhibit A and <br /> incorporated herein by reference, and more particularly described as follows: <br /> The West ''/z of the SW '/4 (Exc. The North 30 feet for Street and <br /> W 30 feet for Street) of Lots 3 & 4; A tract measuring 611.7 feet X 610.83 <br /> feet. PIN Number 04-12-10-301-001. Situated in Macon County, Illinois. <br /> ("Premises"),(legal description on Seller's title to govern). <br /> on which is located a former school building,school site and adjoining green space,last commonly <br /> known and used as an elementary school that has been permanently removed from the District's <br /> building inventory (hereinafter"Property"); and, <br /> WHEREAS, the City seeks to own the Property for redevelopment of the Property to be <br /> used as senior living apartments or other appropriate development("Project"); and, <br /> WHEREAS, the City is seeking to secure necessary and required funding and tax credits <br /> from the Illinois Housing Development Authority("IHDA") for the Project; and, <br /> WHEREAS,the City and the District agree that should the City fail to secure funding and <br /> tax credits from IHDA, and the City be unable to redevelop the Property, the Premises will be <br /> demolished; and, <br /> WHEREAS,the District is desirous of transferring the Property to the City and in assisting <br /> the City with the financial expense of the demolition of the structure located at 1077 W. Grand St. <br /> should it not be redeveloped.; and, <br /> WHEREAS, prior to the District transferring the Property to the City, the City will adopt <br /> an Ordinance Authorizing Acceptance of the Property for a Public Purpose in compliance with the <br /> Local Governmental Transfer Act, 50 ILCS 605/1 et. seq.; and, <br /> WHEREAS, it is in the public interest to maximize the efficient use of District and City <br /> properties; and <br /> WHEREAS, District and City have the authority to enter this Agreement in the manner <br /> set forth herein pursuant to Section 10 of Article VII of the Constitution of the State of Illinois,the <br /> Illinois Intergovernmental Cooperation Act (5 ILCS 220/1 et. Seq.), and the Illinois Local <br /> Government Property Transfer Act (50 ILCS 605/1 et. Seq.). <br /> EXHIBIT A <br />
