WHEREAS, said right-of-way is no longer useful to the public or to the City; and, <br /> WHEREAS, the public interest will be subserved by vacating said right-of-way and the <br /> public will be relieved from the further burden and responsibility of maintaining the same; and <br /> WHEREAS, no compensation shall be required as the proposed public right-of-way <br /> vacations are considered with the redevelopment of the former Prairie Farms property by TCCA- <br /> Tillamook that the City is a redevelopment partner of, and, <br /> WHEREAS, all appropriate utility companies were contacted and expressed no objections <br /> to the proposed vacations. <br /> NOW, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That upon the condition set forth below, the above described right-of-way <br /> be, and the same is hereby, vacated inasmuch as the same is no longer required for public use and <br /> the public interest will be subserved by such vacation, said right-of-way being shown on the plat <br /> thereof hereto attached and hereby made a part hereof. <br /> A. A blanket easement for the vacated East Sangamon Street and a portion of North <br /> Morgan Street right-of-way shall be maintained for all public utilities located within <br /> the right-of-way, including but not limited to the City's utilities. <br /> Section 2. That no right-of-way vacation valuation and compensation rules or <br /> regulations of the City, including those set forth in City Council Policy Section D.3.a and City <br /> Administrative Policy and Procedure Manual Section 2.2.3 shall be a requirement of this <br /> Ordinance and are hereby specifically waived for purposes of this Ordinance <br /> Section 3. The permanent index number of the properties acquiring title to the property <br /> vacated hereby is 04-12-11-377-005,04-12-11-378-003,04-12-11-378-00,04-12-11-378-005,04- <br /> 12-11-378-018 and 04-12-11-379-009. <br /> Section 4. That there is hereby reserved in, over, along and under the above-described <br /> streets and alleyways to the City of Decatur, Illinois, and to the public and to those utilities and <br /> companies as the case may be owning public service facilities, mains, sewers, telephone and <br /> electric, City street lights, circuitry and conduit or other public utilities, such property, rights of <br /> way and easements as are or may be necessary or desirable for continuing public service by means <br /> of such facilities and for the maintenance, renewal and reconstruction thereof with the right of <br /> ingress and egress for such purposes. <br />
