STAFF REPORT <br /> Decatur City Plan Commission <br /> Hearing Date June 6, 2024 <br /> Case No. 24-14 <br /> Property Location East Sangamon Street Right-of-Way <br /> Request Vacation of the 800 Block of East Sangamon Street Right-of-Way <br /> Petitioner Mervis Supply Company, Inc. <br /> Representative David Hicks <br /> BACKGROUND <br /> The petitioner is requesting vacation of the 800 Block of East Sangamon Street. This vacation <br /> along with the previous one (24-13) with TCCA would enable Tillamook to secure their entire <br /> campus and not create an inaccessible portion of a ROW. <br /> Surrounding Land Use and Zoning <br /> Direction Existing Land Use Zoning Comprehensive Plan <br /> Subject Property Street Right-of-Way M-1,M-2 Employment <br /> North Industrial M-1 Employment <br /> South Industrial M-2 Employment <br /> East Industrial,Railroad M-2 Employment <br /> West Industrial M-1,M-2 Mixed-Use Commercial/Residential <br /> STAFF ANALYSIS <br /> The subject street right-of-way has a width of 80-feet and has a length of approximately 306-feet, <br /> with a total of 24,480-square feet. The petitioner owns the property on the south side of the street <br /> to be vacated. <br /> The City is supportive of this vacation as it will facilitate economic development and a controlled <br /> campus for TCCA - Tillamook. More importantly this vacation is being done to prevent an <br /> improved ROW from becoming disconnected from other public ROWs. This section of the ROW <br /> would serve no public benefit beyond the public utilities that may run through it. <br /> The subject right-of-way is no longer necessary to serve the general public, and really has become <br /> a site with repeated illegal dumping and nuisance behaviors. The best interests of the City of <br /> Decatur would be served by approving the proposed right-of-way vacation to eliminate this <br /> liability from the City's public road inventory. <br /> STAFF RECOMMENDATION <br /> Staff recommends approval of the street vacation with the following condition: <br /> 1. A blanket easement for the vacated East Sangamon Street right-of-way shall be <br /> maintained for all utilities located within the right-of-way, including but not limited to the <br /> City's utilities <br /> PLAN COMMISSION ACTION <br />
