Exhibit A <br /> INTERGOVERNMENTAL AGREEMENT FOR <br /> THE SHARING OF CERTAIN COSTS RELATED TO THE IMPROVEMENT OF A <br /> PORTION OF TAYLOR AVENUE IN MACON COUNTY,ILLINOIS,BETWEEN <br /> THE CITY OF DECATUR,AND HICKORY POINT TOWNSHIP <br /> THIS AGREEMENT("Agreement")is entered into by and between the City of <br /> Decatur,Illinois,an Illinois municipal corporation("City")and Hickory Point Township, <br /> Illinois,a unit of local government("Township"). <br /> WHEREAS,the City is a municipal corporation as set forth in the Illinois Municipal <br /> Code, 65 ILCS 511-1-1 et.seq.;and, <br /> WHEREAS,the City is a home rule unit under Article VII Section 6(a)of the Illinois <br /> Constitution; and, <br /> WHEREAS,the Township is a body politic and corporate in the State of Illinois;and, <br /> WHEREAS,the City intends to implement a highway improvement project involving <br /> re-surfacing Taylor Avenue; and, <br /> WHEREAS,the Township is desirous of implementing re-surfacing improvements to <br /> Taylor Avenue under their jurisdiction;and, <br /> WHEREAS,intergovernmental cooperation between the City and the Township is <br /> financially beneficial to all agencies by jointly purchasing re-surfacing services and products; <br /> and, <br /> WHEREAS,the 1970 Illinois Constitution,Art.VII, Section 10 and 5 ILCS 220/3 <br /> provide authority for intergovernmental co-operation;and, <br /> WHEREAS,the Township believes the improvement to Taylor Avenue in Macon <br /> County,Illinois by the City will be of benefit to the health,safety and welfare of the residents <br /> of Macon County;Illinois. <br /> NOW THEREFORE,in consideration of the mutual agreements contained in this <br /> agreement,the City and the Township agree as follows: <br /> 1. The City agrees to act as the Lead Agency for the re-surfacing project unless or <br /> until the City provides the other participating agency thirty(30)days written notice of its <br /> intention to no longer act as Lead Agency. <br /> 2. The responsibilities of the Lead Agency are to facilitate the re-surfacing <br /> project for the participant,including preparing bidding and construction documents, <br /> advertising for the bidding process, and awarding the contract for the project. <br /> Page 1 of 3 <br />
