Chapter 56 <br /> the public generally as a primary means of refuse and recyclables removal. (Amended, <br /> Ordinance No. 2010-89, December 20,2010) <br /> 17. PAYMENT REQUIRED. All owners or occupant of residential premises in the <br /> City shall subscribe to, and be a customer of, the licensee for refuse and recyclables removal for <br /> the residential area containing said premises, as described herein, and it shall be unlawful, and a <br /> violation of this section, for any such owner or occupant to fail at any time to be fully and <br /> lawfully entitled to receive refuse and recyclables removal service from such licensee. It shall be <br /> a defense to any prosecution for a violation hereof that the licensee from whom the property <br /> owner or occupant is required to receive service has failed to provide such service in material <br /> breach of the provisions of this Chapter or any other applicable law or ordinance, or in material <br /> breach of any lawful agreement between said owner or occupant and licensee. Each residential <br /> customer may temporarily interrupt collection service for a minimum two (2)month period once <br /> per year. Any service interruption must be scheduled in advance with the licensee, be for a <br /> minimum two (2)month period and is subject to one stop/start$5 fee. <br /> The rates for refuse and recyclables removal for residential premises are detailed in <br /> Appendix A of this Chapter. Each licensee shall provide service to all residential <br /> producers in each residential area served under such license unless said producers are delinquent <br /> in the payment of any fees for such service, as authorized hereby, or are otherwise in material <br /> breach of the provisions of this Chapter or any other applicable law or ordinance or are in <br /> material breach of any lawful agreement between said owner or occupant and licensee. <br />
