Public Works <br /> DATE: 10/25/2024 <br /> MEMO: 2024-174 <br /> TO: Honorable Mayor Julie Moore Wolfe and City Council Members <br /> FROM: Tim Gleason, City Manager <br /> Matthew C.Newell, P.E., Public Works Director <br /> SUBJECT: Resolution to Appropriate Motor Fuel Tax Funds for the Replacement of the Jasper Street Underpass <br /> Lighting by Municipality under the Illinois Highway Code, City Project 2024-19, Section 24-00419-00-LT <br /> SUMMARY RECOMMENDATION: <br /> It is recommended that the City Council approve the attached Resolutions authorizing the Mayor to sign and the City Clerk to <br /> attest the following: <br /> 1. Appropriating$200,000 in State Motor Fuel Tax(MFT)funds for the proposed Jasper Street Underpass Lighting project,City Project 2024-19, <br /> Section 24-00419-00-LT;and <br /> 2. Resolution authorizing the execution of an agreement with the Norfolk Southern Railway Company for the replacement of the Jasper Street <br /> underpass lighting as part of City Project 2024-19,Section 24-00419-00-LT. <br /> BACKGROUND: <br /> State Motor Fuel Taxes(MFT)are levied and collected by the State of Illinois;funds are allocated to local agencies and are <br /> administered by the Illinois Department of Transportation(IDOT). The City is required to adopt a resolution specifying the <br /> allocation of State MFT funds to their intended projects. IDOT must receive an MFT appropriation before approval of the <br /> expenditure of State MFT money. The first resolution appropriates $200,000 in State MFT funds for the replacement of <br /> underpass lighting and railroad flagging costs. <br /> The conduit,wire,and fixtures in the Jasper Street Underpass are in disrepair and need replaced. Several lights in the underpass <br /> are inoperable making for unsafe conditions for the traveling public,especially for pedestrians at night. <br /> The underpass has two separate structures with the North structure owned by the Norfolk Southern Railway Company and South <br /> structure owned by the Decatur and Eastern Illinois Railroad. Given the underpass structure is railroad property and work will <br /> take place in railroad right of way,the Norfolk Southern Railway requires the City to obtain a right of entry permit for the work. <br /> The Decatur and Eastern Illinois Railroad has provided the City written approval to perform the work. <br /> SCHEDULE: <br /> Design work for the Jasper Street Underpass Lighting Project,is complete. The project is planned to begin spring of 2025 with <br /> an expected completion May 2025. <br /> LEGAL REVIEW: Legal review of the State Motor Fuel Tax appropriation is not required. <br /> PRIOR COUNCIL ACTION: <br /> Each year the City Council approves the appropriation of State MFT funds for street maintenance work. State MFT funds are <br /> allocated for street maintenance work as part of the Fiscal Year 2024 Capital Improvement Plan. <br /> October 28, 1913—Council approved Ordinance 158 entering into an agreement with Norfolk Southern Railway Company <br /> (formerly Wabash Railroad Company)and Decatur&Eastern Illinois Railroad(formerly Cincinnati,Hamilton&Dayton <br /> Railway Company)to elevate their tracks over Jasper Street. As part of that agreement,maintenance of the underpass lighting is <br /> the responsibility of the City of Decatur. <br /> POTENTIAL OBJECTIONS: There are no known objections to resolutions. <br />
