<br /> holidays, as defined by appliable federal and state statute and/or One Call Center holidays, outside of
<br /> the USIC's normal business hours (7:00 am—5:00 pm).
<br /> 1.11 Excavator(s) means any person or entity which engages directly in excavation.
<br /> 1.12 Facility(ies) means any item used in connection with the storage or conveyance of water, sewage,
<br /> electronic telephonic or telegraphic communications, cablevision, electric energy, petroleum products,
<br /> gas, gaseous vapors, Hazardous Materials or other substances including, but not limited to, pipes,
<br /> sewers, conduits, cables, valves, lines, wires, manholes, attachments and those parts of poles or
<br /> anchors, either above or below ground.
<br /> 1.13 Gridding means the geographic boundary area, maps, facility records, and/or other facility
<br /> documentation identified by Customer and the One Call Center and provided to the applicable state One
<br /> Call Center which is used to determine whether a request for Locate will generate a Ticket for Customer
<br /> after receipt of an Excavator's notification of intent to excavate (i.e., receipt of a Locate Ticket).
<br /> 1.14 Hazardous Materials means any toxic or hazardous substance, hazardous material, dangerous or
<br /> hazardous waste, dangerous good, radioactive material, petroleum or petroleum-derived products or by-
<br /> products, or any other chemical, substance, material or emission, that is regulated, listed or controlled
<br /> pursuant to any national, state, provincial, or local law, statute, ordinance, directive, regulation or other
<br /> legal requirement of the United States ("U.S.") or the country of the Site.
<br /> 1.15 Interruption of Service means an interruption in the services provided by Customer to its customers
<br /> arising from a Damage to Customer's Facilities.
<br /> 1.16 Locatable Facilities means Customer's Facilities that can be located with Reasonable Accuracy by using
<br /> devices designed to respond to the presence of Customer's Facilities, together with records and facility
<br /> prints, drawings, and maps of sufficient accuracy, but shall specifically not include Unidentifiable Facilities
<br /> and Unlocatable/Untonable Facilities.
<br /> 1.17 Locate(s) means the process of providing Locate Services in response to an Excavator's notice of intent
<br /> to excavate, and such Locate Services provided by USIC in accordance with this Contract. As used in
<br /> this Contract, Locate(s) include(s) "Project Locate", as defined hereinafter, where applicable in
<br /> accordance with the definition of"Project Locate" hereunder.
<br /> 1.18 Locate Service(s) means the services, of any type of ticket, to be provided by USIC under this Contract
<br /> consisting of the process of verifying if Customer's Facilities are present at a location where an Excavator
<br /> intends to or conducts excavation; when applicable, detection of Customer's Facilities through the use of
<br /> electronic locating equipment; and, when applicable, Marking to identify the existence and location of
<br /> Customer's Facilities.
<br /> 1.19 Locator At Fault Damage means Damage to Customer's Facilities caused by an Excavator that occurs
<br /> as a direct result of USIC not performing the Locate with Reasonable Accuracy. Locator At Fault Damage
<br /> does not include alleged Damage to Customer's Facilities arising from USIC's late or untimely Locates
<br /> that were performed with Reasonable Accuracy prior to the damage occurring.
<br /> 1.20 Locator Not At Fault Damage means Damage to Customer's Facilities that occurs for any reason other
<br /> than USIC not performing the Locate with Reasonable Accuracy.
<br /> 1.21 Mark(s)(ed)(ing) means the use of stakes and flags, paint or other clearly identifiable materials at
<br /> appropriately distanced intervals and at each divergence from a straight line in accordance with the
<br /> current marking standards of the American Public Works Association.
<br /> 1.22 One Call Center or 811 means each state's Ticket issuing system for all excavation notices.
<br /> 1.23 Positive Response is an 811 notification that communicates to facility owners and operators, and
<br /> Excavators the status of dig/excavation notices issued by 811.
