The Developer shall cause the Project to be commenced and to <br /> be prosecuted with due diligence and in good faith in accordance with the terms of this <br /> Agreement,and without undue delay and shall cause the Project to be performed in a good <br /> and workmanlike manner in accordance with the approved plans for the Project. <br /> 2.5 Rights of Inspection. <br /> During improvement of the Project,the City or its designee shall have the right at any time <br /> and from time to time to enter upon the Project for the purposes of inspection upon <br /> reasonable prior notice to Developer. In no event will City's exercise of its inspection <br /> rights unreasonably interfere with Developer's completion of the Project. <br /> 2.6 Enterprise Zone and Related Benefits. <br /> Developer shall apply for Enterprise Zone benefits through the Economic Development <br /> Corporation of Decatur and Macon County seeking property tax abatement on the <br /> incremental increase in property taxes generated by the Project and a waiver of State and <br /> local sales taxes on the purchase of those eligible materials used in the Project as permitted <br /> by Applicable Law. Further, Developer may apply for any other available local, State or <br /> Federal tax incentives in connection with the Project including, without limitation, New <br /> Markets Tax Credit. <br /> ARTICLE III:CITY Obligations <br /> 3.1 Public Investment. <br /> The City shall provide the Public Investment pursuant to Article IV below. <br /> 3.2 Zoning. <br /> It is contemplated by the City and the Developer that the Project shall have a zoning <br /> classification which will permit the use of the Project as intended by this Agreement. City <br /> will use reasonable efforts, in accordance with Applicable Laws, to assist Developer in <br />
