INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF DECATUR AND <br /> DECATUR PARK DISTRICT REGARDING A TRANSFER OF REAL ESTATE <br /> REAL ESTATE TRANSFER FOR PORTIONS OF GARFIELD PARK <br /> THIS AGREEMENT is made and entered into this 6th day of May, 2024 by and between <br /> City of Decatur, an Illinois municipal corporation (hereafter "City"), the Decatur Park District, <br /> an Illinois unit of local government (hereafter"DPD"),. The parties mutually desire to enter into <br /> this Agreement and further stipulate and agree as follows: <br /> WHEREAS, the 1970 Illinois Constitution, Art. VII, Section 10 and 5 ILCS 220/3 <br /> provide authority for intergovernmental co-operation; and, <br /> WHEREAS, City and DPD are both public agencies as defined under the <br /> Intergovernmental Cooperation Act (5 ILCS 220/1 et. seq.), and are therefore authorized and <br /> empowered to enter into intergovernmental agreements whereby they may exercise, combine, <br /> transfer and enjoy jointly any powers,privileges, functions, or authority; and <br /> WHEREAS, City and DPD have both determined that it is in the public interest and <br /> general welfare of the citizens of City and DPD to cooperate by transferring certain parcels of <br /> real estate from DPD to City which will prove useful to each entity and will be for the public <br /> interest; and <br /> WHEREAS, both the Illinois Municipal Code and Illinois Park District Code authorize <br /> the parties to perform their respective obligations under this Agreement; <br /> WHEREAS, no ordinances or laws prohibit this Intergovernmental Agreement or the <br /> transaction provided for herein. <br />
