NOW,THEREFORE,BE IT ORDAINED,BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the report and recommendation of the Decatur City Plan Commission be, and the same is hereby,received,placed on file and approved. Section 2. That upon compliance with the conditions described herein, and in the site plan attached hereto and hereby made a part hereof as Exhibit A, said herein described premises be, and they are hereby, rezoned from B-1 Neighborhood Shopping District to PD Planned Development District. 1. The only permitted use for this Planned Development is indoor event venue: such as weddings, receptions, bridal and baby showers, fundraisers, markets, retirement parties,reunions, and other private gatherings. 2. No outdoor event venue use will be allowed on the site.No outdoor use of amplification equipment nor bands outside will be allowed on the site. 3. Video gaming terminals will not be allowed on the site. 4. Hours of operation shall only be permitted between the hours of 8:00 AM and 11:00 PM. 5. Any existing or future refuse disposable areas shall be screened in accordance with Section XXVIII.E.2.c of the City's Zoning Ordinance. 6. All signage shall meet the requirements of Section XXVI.F of the City's Zoning Ordinance. 7. Building drawings and a permit application for the remodel of the existing Emerald Room, kitchen and restrooms shall be submitted for review and approval by the City's Building Inspections Division prior to a Certificate of Occupancy being issued. 8. Event venue use beyond the existing Emerald Room and/or more than 100 occupants shall not be allowed until a PD Amendment petition is resubmitted for review and approval by the City Council and additional building drawings and permit application for the remodel of the rest of the building are submitted for review and approval by the City's Building Inspections Division. Section 3. That the Districts hereinabove mentioned are those districts set forth and defined in Ordinance No. 3512 of the City of Decatur,Illinois,commonly known as the Zoning Ordinance, and all the provisions,regulations,restrictions and requirements therein set forth shall apply to the premises described herein. Section 4. That the zoning of said premises as set out herein shall be shown and verified on the Zoning District Map as in such Ordinance No. 3512 provided and said Districts be,and they are hereby, amended and changed as herein set forth.
