NOW,THEREFORE,BE IT ORDAINED,BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That the report and recommendation of the Decatur City Plan Commission be, <br /> and the same is hereby,received,placed on file and approved. <br /> Section 2. That upon compliance with the conditions described herein, and in the site plan <br /> attached hereto and hereby made a part hereof as Exhibit A, said herein described premises be, <br /> and they are hereby, rezoned from B-1 Neighborhood Shopping District to PD Planned <br /> Development District. <br /> 1. The only permitted use for this Planned Development is indoor event venue: such as <br /> weddings, receptions, bridal and baby showers, fundraisers, markets, retirement <br /> parties,reunions, and other private gatherings. <br /> 2. No outdoor event venue use will be allowed on the site.No outdoor use of amplification <br /> equipment nor bands outside will be allowed on the site. <br /> 3. Video gaming terminals will not be allowed on the site. <br /> 4. Hours of operation shall only be permitted between the hours of 8:00 AM and 11:00 <br /> PM. <br /> 5. Any existing or future refuse disposable areas shall be screened in accordance with <br /> Section XXVIII.E.2.c of the City's Zoning Ordinance. <br /> 6. All signage shall meet the requirements of Section XXVI.F of the City's Zoning <br /> Ordinance. <br /> 7. Building drawings and a permit application for the remodel of the existing Emerald <br /> Room, kitchen and restrooms shall be submitted for review and approval by the City's <br /> Building Inspections Division prior to a Certificate of Occupancy being issued. <br /> 8. Event venue use beyond the existing Emerald Room and/or more than 100 occupants <br /> shall not be allowed until a PD Amendment petition is resubmitted for review and <br /> approval by the City Council and additional building drawings and permit application <br /> for the remodel of the rest of the building are submitted for review and approval by the <br /> City's Building Inspections Division. <br /> Section 3. That the Districts hereinabove mentioned are those districts set forth and defined <br /> in Ordinance No. 3512 of the City of Decatur,Illinois,commonly known as the Zoning Ordinance, <br /> and all the provisions,regulations,restrictions and requirements therein set forth shall apply to the <br /> premises described herein. <br /> Section 4. That the zoning of said premises as set out herein shall be shown and verified <br /> on the Zoning District Map as in such Ordinance No. 3512 provided and said Districts be,and they <br /> are hereby, amended and changed as herein set forth. <br />
