14. CITY'S RIGHT TO SUSPEND WORK AND/OR REMOVE CONTRACTOR FROM <br /> JOB SITE. <br /> The City and the Contractor agree that the City retains the right to stop work at any time <br /> during the project for violation of regulations, rules or guidelines regarding worker <br /> safety, as promulgated by (i)OSHA; (ii)the U.S. or Illinois Environmental Protection <br /> agencies; (iii) the Illinois Department of Public Health; or (iv)the City of Decatur's in- <br /> surer for pollution liability. <br /> i. The City's right to stop work shall not require prior notice from the City to <br /> the Contractor,and may be immediate, instant and without delay. <br /> ii. The City also retains the right, in cases of serious or repeated violation that <br /> endanger the safety of workers,the environment, surrounding properties <br /> and/or persons in the vicinity of the worksite,to stop work immediately <br /> and remove the contractor from the job site. In the event the Contractor is <br /> removed from the job site, the Contractor shall secure the property, includ- <br /> ing protecting the property and mitigating potential risks that could result <br /> in damage or loss due to theft,burglary, vandalism, fire, water, wind, or <br /> any other Act of God,and turn all keys over to the City prior to leaving <br /> the job site. <br /> iii. The City of Decatur also retains the right in cases of unsatisfactory work <br /> ongoing issues,to suspend work and terminate contact.Contractors will be <br /> notified and have 7 days to correct and complete work. <br /> iv. In instances where the City stops work and/or removes the Contractor from <br /> the job site,the City shall orally cite to the Contractor the reasons for its <br /> action. The City shall serve written notice citing the reasons personally or <br /> by certified mail, return receipt requested,within three(3)business days <br /> from the date of the City's act,unless the Contractor named in this <br /> Agreement has resumed work under this Agreement. If the Agreement is <br /> terminated pursuant to Paragraph 13, the Contractor shall be paid only for <br /> the line items which are completed in a satisfactory manner to Owner and <br /> City of the work completed, as determined by the Owner and the City. <br /> 15. MEDIATION <br /> The City shall be the interpreter of the requirements in connection with the work and <br /> shall mediate all claims and disputes between the Owner and the Contractor regarding the <br /> work. The City's decisions shall be final and binding. <br /> The City shall issue a written decision within five (5) days of the written notification by <br /> either the Owner or the Contractor of any dispute. <br /> v.9.2025 5 <br />
