RESOLUTION NO. R 172-W)a0 - 1)4 <br /> RESOLUTION AUTHORIZING THE EXECUTION OF A DEVELOPMENT <br /> AGREEMENT FOR A COMMERCIAL SOLAR ENERGY FACILITY WITH <br /> DECATUR NORTHWEST 1, LLC <br /> WHEREAS, Decatur Northwest 1, LLC ("Developer")has an equitable and/or <br /> legal interest in real property located in the City of Decatur, Illinois, identified as PIN 07- <br /> 07-29-476-006; and, <br /> WHEREAS, the Developer proposes to construct, operate, and maintain a <br /> commercial-scale solar energy facility on the subject property; and, <br /> WHEREAS, the Plan Commission held a duly noticed public hearing on <br /> November 6, 2025, and the City Council finds that a Development Agreement is <br /> necessary to ensure appropriate development standards, decommissioning requirements, <br /> and financial assurances; and, <br /> WHEREAS, the City Council finds that approval of the Development Agreement <br /> between the parties, attached hereto and marked Exhibit A, is in the best interest of the <br /> City of Decatur. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF DECATUR, ILLINOIS: <br /> Section 1. That the City Council hereby approves the Development Agreement <br /> between the City of Decatur, Illinois and Decatur Northwest 1, LLC, substantially in the <br /> form presented and as required by Ordinance No. 2026-02. <br /> Section 2.
