NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, MACON COUNTY, ILLINOIS: <br /> Section 1.That the Development Agreement by and between the City of Decatur,Illinois <br /> and Broadwing Energy, LLC, a Delaware limited liability company, attached hereto and made a <br /> part hereof, is hereby approved. <br /> Section 2. The City Manager is hereby authorized and directed to undertake any and all <br /> actions as may be required to implement the terms of said Agreement. <br /> Section 3. In the event that any section, clause, provision, or part of this Ordinance shall <br /> be found and determined to be invalid by a court of competent jurisdiction, all valid parts that <br /> are severable from the invalid parts shall remain in full force and effect. <br /> Section 4. This Resolution is enacted pursuant to the home rule authority of the Decatur, <br /> granted by Article VII, Section 6 of the 1970 Illinois Constitution. <br /> Section 5.
