At the request of the Developer,and funded through monthly payments by the <br /> Developer,the City will be responsible for the design and construction of the water <br /> main improvements to be completed and commissioned no later than August 1,2029, <br /> absent unreasonable delays caused by Developer,which design shall be in accordance <br /> with all applicable federal,state and local laws and regulations. City shall retain <br /> licensed and bonded contractors with professional experience and qualifications <br /> necessary to design and construct the water main improvements in conformance with <br /> the customary standard of care in the industry.Developer shall be given a reasonable <br /> opportunity to review and approve the Project scope and specifications,all material <br /> contracts with contractors(>$50,000),terms and conditions, schedule and milestones, <br /> and cost estimates prior to the City proceeding with the bid process or executing any <br /> such contract for which Developer will be expected to reimburse costs. A Project <br /> schedule,notices,change in schedule will be provided to Developer as the Project <br /> progresses for its timely review and approval. <br /> B. Once the water main improvements are complete, the City will retain ownership and <br /> provide all future maintenance of the water main in accordance with all applicable federal,state <br /> and local laws and regulations. <br /> C.The City will provide to the Developer regular opportunities for input throughout the <br /> design process for the water main improvements, including invitations to regular meetings, <br /> providing copies or reports of those meetings and opportunities to change the course of the <br /> project or end the project. The Developer must provide a thirty(30)day written notice to the <br /> City to end such project and must reimburse the City for all costs incurred up to the date of <br /> termination.Definitive values and dates related to the water main project will be provided once <br /> the construction project is under contract. <br /> D.Provided the Developer has satisfied the requirements as stated in Section 2D above, <br /> the City hereby agrees to be responsible for the design and construction of the sanitary sewer lift <br /> station and force main to be completed and commissioned as soon as reasonably practicable and <br /> in any event no later than August 1,2029,absent any unreasonable delays caused by Developer. <br /> City shall retain licensed and bonded contractors with professional experience and qualifications <br /> necessary to design and construct the water main improvements in conformance with prudent <br /> industry practices. Developer shall be given a reasonable opportunity to review and approve the <br /> Project scope and specifications,all material contracts with contractors(>$50,000),terms and <br /> conditions, schedule and milestones, and cost estimates prior to the City proceeding and <br /> executing any such contract for which Developer will be expected to reimburse costs.
