violations still existing; the City, in its sole discretion,may extend the period to correct the issue. <br /> DOVE may be charged a re-inspection fee. Frequency of inspections: the first on-site ongoing <br /> inspection must occur within 12 months after the project completion. An inspection must be <br /> conducted at least once every year thereafter. If any deficiency is identified, a follow-up on-site <br /> inspection is required within twelve(12)months. Health and safety deficiencies identified during <br /> the inspection must be corrected immediately and more frequent inspections may be scheduled <br /> for the property at the City's discretion. DOVE must submit an annual certification to the City <br /> certifying that the building and all HOME-assisted units in the project are suitable for <br /> occupancy. HOME assisted units must be inspected every two years by the City. <br /> Section 19. DOVE shall not use any funds provided under this Agreement for religious <br /> activities, to promote religious interests,or for the benefit of a religious organization in <br /> accordance with the federal regulations specified in 24 CFR 92.504(c)(3)(x). <br /> Section 20. DOVE shall comply with all the provisions of HUD regulations identified in <br /> 24 CFR Part 92, as now written, or subsequently amended. <br /> Section 21. DOVE shall conduct, and submit to City,an annual tenant survey, in a <br /> manner prescribed by City,describing the socioeconomic characteristics of the tenants, and the <br /> monthly rent and utility charged for each unit. <br /> Section 22. DOVE agrees to provide the City with regular progress reports due on the <br /> 15`h of each month and all other reports which may be required by the City for compliance with <br /> HUD, Freedom of Information Act and any other federal or state law,statute, or other regulation. <br /> Section 23. DOVE agrees to comply with Title VI of the Civil Rights Act of 1964; Title <br /> VII of the Civil Rights Act of 1968; Section 104(b)and Section 109 of the Housing and <br /> Community Development Act of 1974, as amended; Section 504 of the Rehabilitation Act of <br /> 1973; the American with Disabilities Act of 1990 as amended, and the Age Discrimination Act <br /> of 1975 as amended. <br /> Section 24. DOVE hereby assumes liability for and agrees to protect, hold harmless, and <br /> indemnify the City, its assigns,officers,employees, directors, agents and servants from and <br /> against all liabilities, obligations,losses,damages,penalties,judgments,settlements, claims, <br /> actions, suits,proceedings, costs,expenses, and disbursements, including legal fees and expenses <br /> of whatever kind and nature, imposed on, incurred by or asserted against the City, its assigns, <br /> officers, employees,directors, agents, and servants in any way relating to or arising out of any <br /> allegations, claims, or charges regarding the use of the Funds by DOVE,including but not <br /> limited to the violation by DOVE of any of its covenants or agreements under this Agreement, <br /> and any injury to any person, loss of life, or loss or destruction of property in any way arising out <br /> of or relating to the performance or operation of DOVE's operations and use of Funds. <br /> Section 25. All Notices shall be in writing and delivered in person, or by overnight <br /> delivery service with receipt, or deposited in the United States Mail,postage prepaid,by certified <br /> or registered mail,return receipt requested,to the address set forth below, or at such other place <br /> as a party may designate by written notice to all parties.
