Council Memo <br /> Public Works Department <br /> No. 2026-17 <br /> DATE: 2/17/2026 <br /> TO: Honorable Mayor Julie Moore Wolfe and City Council Members <br /> FROM: Melissa Hon,Interim City Manager <br /> Matt Newell,Director of Public Works <br /> SUBJECT: <br /> Ordinance Amending Ordinance No. 2023-66 Prohibiting the Use of Groundwater as a Potable Water <br /> Supply by the Installation or Use of Potable Water Supply Wells or by Any Other Method Within a <br /> Certain Area in the City of Decatur Former Decatur Manufactured Gas Production Site 515 East Main <br /> Street <br /> SUMMARY RECOMMENDATION: Staff recommends that the attached Ordinance Amending Ordinance <br /> No. 2023-66 prohibiting the use of groundwater as a potable water supply within a certain area in the City be <br /> approved. <br /> BACKGROUND: <br /> Ordinance No. 2023-66 was passed by the City Council on October 2, 2023. Upon recent review by Ameren <br /> and the Illinois EPA, it was determined that the legal description provided by Ameren for the original ordinance <br /> was in error. All other legal documents and notices were correct. This Ordinance amends the past Ordinance <br /> by replacing the legal description. <br /> LEGAL REVIEW: The original ordinance was reviewed by the Legal Department. <br /> PRIOR COUNCIL ACTION: <br /> October 2,2023 - Council approved Ordinance 02023-66 prohibiting the use of groundwater as a potable <br /> water supply for the designated area south and west of a former manufactured gas plant located at 515 East <br /> Main Street. <br /> POTENTIAL OBJECTIONS: There are no known objections. <br /> INPUT FROM OTHER SOURCES: <br /> Ameren Illinois <br /> STAFF REFERENCE: Matt Newell, Public Works Director.
