<br /> GRANT OF TEMPORARY CONSTRUCTION EASEMENT
<br /> MJERT, LLC-3, ("Grantor"),for and in consideration of$10.00,the receipt and sufficiency
<br /> of which Grantor hereby acknowledges, does convey and grantto the Sanitary District of Decatur
<br /> ("Grantee"), its successors and assigns, a temporary construction easement, 20 foot in width,for
<br /> the purpose of laying, constructing, removing, replacing, inspecting, renewing, maintaining,
<br /> repairing, using, operating, installing, and protecting underground utilities including sanitary
<br /> sewer, water lines, manholes,junction boxes and other utilities and related appurtenances, said
<br /> easement being shown on the attached exhibit,which exhibit is made a part of this Agreement,
<br /> together with the right to construct, remove, replace, inspect, renew, maintain, repair, use,
<br /> operate, protect, and install all necessary facilities incident to the utilities.The easement shall run
<br /> on, under,over, and across the property described as follows:
<br /> A 20-foot-wide strip of land being part of the Southwest Quarter of the Northwest Quarter of
<br /> Section 1,Township 16 North, Range 2 East of the Third Principal Meridian,City of Decatur,
<br /> Macon County, Illinois.
<br /> Said TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows:
<br /> Commencing at the northeast corner of said Southwest Quarter,thence South 00 degrees 25
<br /> minutes 31 seconds East(bearings assumed for description purposes only) along the east line
<br /> of said Southwest Quarter, 160.62 feet to the Point of Beginning.
<br /> From said Point of Beginning, thence North 52 degrees 43 minutes 41 seconds West, 40.98
<br /> feet; thence South 37 degrees 16 minutes 19 seconds West, 75.03 feet; thence South 87
<br /> degrees 52 minutes 54 seconds West, 25.88 feet; thence North 37 degrees 16 minutes 19
<br /> seconds East, 111.46 feet; thence South 52 degrees 43 minutes 41 seconds East,45.53 feet to
<br /> a point on said East line; thence South 00 degrees 25 minutes 31 seconds East along said East
<br /> line, 25.28 feet to the Point of Beginning.
<br /> Said 20-foot-wide easement contains 0.06 acres (2,730 square feet), more or less.
<br /> together with the perpetual right of access, ingress,and egress to and from the property herein
<br /> described for the purpose aforesaid.
<br /> The easement, grants, and other provisions contained herein shall constitute a covenant
<br /> running with the land for the benefit of Grantee, its successors and assigns. Without limiting the
<br /> generality of the foregoing, itis expressly covenanted and agreed between the Grantor and the
<br /> Grantee herein,and as covenants running with the land herein described, as follows:
